- U# j5 t8 o% y9 W4 |0 }( O 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
+ h" P0 ]1 `. _4 i: u, q 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。! B- Q9 w! `6 V! E
第三条 中华人民共和国不承认中国公民具有双重国籍。2 M5 F' I0 \* M3 F) j7 P0 L
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) v4 y$ [; ]1 W! s 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
- J& h' |- H8 ?3 v; k 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
; H, H; ^( T1 v9 E6 A8 c' k6 l8 ` 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;+ z" C' u6 I' m+ ?

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
& A( ^* x8 K/ a+ ~ 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。+ b w$ K% ?* I
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
# J* C5 R. z( z$ {7 R 一、外国人的近亲属;
/ C u8 P9 S( p( K" p6 A) Z& _ 二、定居在外国的;
" N z, ?0 Y8 j4 I$ S 三、有其它正当理由。
0 X4 _) _2 L8 i3 L# ~% i# ~: L 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
+ i5 K; j6 H! ?& x5 o6 N4 z 第十二条 国家工作人员和现役军人,不得退出中国国籍。
% F/ W. |$ l% k. V0 \ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。: r8 Q+ @5 p6 P0 D- n1 W- C
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 u. X* o) j) a, d# L" x& e
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。3 ^& c- m! r5 B) ?$ `: f2 }7 W
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

Article 1
- `2 j( e9 |0 b( l! y: JThis Law is applicable to the acquisition, loss and restoration of
7 U' H9 w# p0 w8 A P5 ~1 _2 t" Inationality of the People''s Republic of China.

7 n' R1 V" N( m9 ]/ D3 ^The People''s Republic of China is a unitary multinational state; persons' Q9 x$ C! \; j: T
belonging to any of the nationalities in China shall have Chinese4 D, X8 @" M5 S7 f6 `' ]

Article 3
G, z& D" f+ h9 O ]The People''s Republic of China does not recognize dual nationality for any
# M" J7 \5 c* N+ ]0 r0 DChinese national.

) u' \/ ^1 I" V) [! Y6 y/ t; m4 vAny person born in China whose parents are both Chinese nationals or one5 O2 f" C7 m3 @) ]& r$ z
of whose parents is a Chinese national shall have Chinese nationality.7 d/ q& U# h" S+ J" x/ p
Article 5' f7 h, F. o+ z+ g! d7 S
Any person born abroad whose parents are both Chinese nationals or one of9 [: S! [/ s. B
whose parents is a Chinese national shall have Chinese nationality. But a/ M: `5 W t6 [$ z
person whose parents are both Chinese nationals and have both settled
: D* B, m( \5 u' W& L: e: c, `abroad, or one of whose parents is a Chinese national and has settled
?1 b8 Z! P C$ s2 g5 Qabroad, and who has acquired foreign nationality at birth shall not have- }. t' [0 i( U9 L2 l! P

Article 6
' F5 y; U4 O& R! n4 aAny person born in China whose parents are stateless or of uncertain7 G# R7 z" ?- C4 A0 p
nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s* x; o, Z; r, C \
Constitution and laws and who meet one of the following conditions may be
( w% z3 m5 D7 K# Ynaturalized upon approval of their applications:* M" e3 }3 P3 J5 {! V) ?
(1) they are near relatives of Chinese nationals;
. v4 e" J& f+ p3 u- I3 k7 G(2) they have settled in China; or
$ _1 Y/ E7 A! }(3) they have other legitimate reasons.. }, D+ s4 U& {: p* L
Article 8
6 U, ?) Q/ f' p, q7 W) C6 m) yAny person who applies for naturalization as a Chinese national shall! F5 n* S% k$ T4 a* ?
acquire Chinese nationality upon approval of his application; a person7 w- G1 [, q$ Q- V! d: r
whose application for naturalization as a Chinese national has been- |9 B. [; F7 Q2 Q+ i; }
approved shall not retain foreign nationality.. }# k2 |* t+ E' I/ C
Article 9$ B, `/ \4 o- {( o. s: k* ]
Any Chinese national who has settled abroad and who has been naturalized
) y- w) e; \. o6 c: w+ oas a foreign national or has acquired foreign nationality of his own free
' E! Z6 ~1 ?. L/ @4 j$ f1 _8 Nwill shall automatically lose Chinese nationality.
- ~( Q( n/ m5 M4 v: t( x/ VArticle 10( h$ T1 V! w& f0 D2 j5 P4 D
Chinese nationals who meet one of the following conditions may renounce: u) q7 k# J* `) }5 S1 `
Chinese nationality upon approval of their applications:
5 \ v2 V8 U7 |3 u! N' w5 `: f(1) they are near relatives of foreign nationals;
+ Q$ W1 [' M' G2 H& |(2) they have settled abroad; or6 {) L; f) \/ X3 N1 Z4 _% f

Article 11
% x- e& {3 t, ~! E5 u) @* QAny person who applies for renunciation of Chinese nationality shall lose- |; E0 N3 J& F$ k
Chinese nationality upon approval of his application.
) `1 ]0 V( ?9 T Z+ CArticle 12( H6 K! N7 P, J* D N; [/ u
State functionaries and military personnel on active service shall not
3 Q; D/ t( T: [. erenounce Chinese nationality.

8 \/ Y- L4 H$ n7 eForeign nationals who once held Chinese nationality may apply for' {4 j" b' Z. ?8 n8 u0 H
restoration of Chinese nationality if they have legitimate reasons; those
) S* S, }/ p2 c# C: `whose applications for restoration of Chinese nationality have been, Z/ J/ n7 {2 F
approved shall not retain foreign nationality.( D0 f9 s7 u2 k0 \
Article 14
7 c: D$ Y* j& R% MPersons who wish to acquire, renounce or restore Chinese nationality, with( E; O$ ^# @/ m! P3 k `9 k& [
the exception of the cases provided for in Article 9, shall go through the- ^% F1 p- c& ~0 |- S( l9 _: P% Z
formalities of application. Applications of persons under the age of 18
9 u, C6 j; q& E* f2 W# e" Z0 g& dmay be filed on their behalf by their parents or other legal# `/ l% N. G9 N. m8 E
representatives.. x( g1 G' Q6 \. o1 ^4 f1 R/ C
Article 15
9 X* r" M& X3 I: M- S |# uNationality applications at home shall be handled by the public security
. L Y W/ P$ D; y& e6 S! h* Zbureaus of the municipalities or counties where the applicants reside;
M" V. k: u5 x: A2 D; F: x o& A: \nationality applications abroad shall be handled by China''s diplomatic
& {# {4 K6 s& U& prepresentative agencies and consular offices.0 |7 U5 V; Z; n
Article 16
' T; l" o6 {5 z4 oApplications for naturalization as Chinese nationals and for renunciation/ K1 l- q) V$ t) G5 h5 S
or restoration of Chinese nationality are subject to examination and
1 g3 E: o9 q0 l1 l. q1 {* Xapproval by the Ministry of Public Security of the People''s Republic of7 G o* K% y, K. F
China. The Ministry of Public Security shall issue a certificate to any
' M8 ?) R) ~, E! sperson whose application has been approved.
2 v3 ]# }: M; K7 lArticle 17+ E3 d5 _5 i1 C9 {
The nationality status of persons who have acquired or lost Chinese
* a- N g8 Z6 \. ?8 D6 O2 Lnationality before the promulgation of this Law shall remain valid.2 S; }! S( C( L* y
Article 183 v1 [5 K! N8 |% Q
This Law shall come into force on the day of its promulgation. |
