《中华人民共和国国籍法》
+ r4 H+ O, f4 M7 ?* q5 ~/ _  ) W- k% ], M6 t. e
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。2 R1 a* Y, e+ |; w; D9 I
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
8 ]+ W- F" |9 q% U, o, I    第三条    中华人民共和国不承认中国公民具有双重国籍。2 i& @* D0 y: K% l* d
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, z8 |& G) ~' \$ e    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
/ C  k# k# S8 w1 F; m2 k+ v    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
0 O$ h( ]$ `4 i9 _' x/ o    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
' n  y2 x& N% y: J7 P7 I" `- f    一、中国人的近亲属;5 T& o' l+ o3 P4 C( ^* _
    二、定居在中国的;
2 N5 O. |/ F4 }4 l+ _! p    三、有其它正当理由。
% Z; [$ C9 t% A: P, M1 @7 Q' y    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
4 `5 x' e" \9 l  s$ w    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。  x& b, P6 g. v9 Y2 a! |
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
' L9 I% w( a4 ?/ A2 _1 ]    一、外国人的近亲属;2 \/ j! h& x  H6 H$ X( ~4 t* n, @
    二、定居在外国的;; s4 Z! u! z& \
    三、有其它正当理由。
- h  n: F% O) v9 r* S" l    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
1 [- o& ~, K9 x( Q8 K; y9 N. ^    第十二条   国家工作人员和现役军人,不得退出中国国籍。) I+ b! e% m4 {/ G3 K% p, |
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
; a4 ]8 n4 l; a7 L( ?* A    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
  Z4 @! l  k% M) y0 B1 R. v    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
+ q- ]2 V) C# C    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。& ^6 j0 R' A1 R2 E% ?; F
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。" l5 Q' E! Q& u
    第十八条   本法自公布之日起施行。

7 d) K0 J! t% J3 ?Committee of the  National  People''s  Congress  on  and  effective  as  of

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of" }" ]: v  ^$ |9 a8 ]- G* L
nationality of the People''s Republic of China.
* i, d1 X8 P# }5 aArticle 2# F" n! z7 q0 b
The People''s Republic of China is a unitary multinational  state;  persons
! E( E; y4 n) u) ^0 i+ k; W8 L* m0 Cbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese4 D; f3 j$ v* P1 z0 V. c
nationality.3 Q0 b/ W3 U0 L" _5 `* X1 N
Article 3! `" S0 k$ T% I9 x6 H: g8 M) s
The People''s Republic of China does not recognize dual nationality for any7 d. l" ^; Z) J! v0 ^
Chinese national.

4 S! l5 I. C: JAny person born in China whose parents are both Chinese nationals  or  one& p9 ]* A" q0 V" o0 P- v
of whose parents is a Chinese national shall have Chinese nationality.6 D7 ~, H, g- Z
Article 52 {& _% N" N# v1 g; H' U
Any person born abroad whose parents are both Chinese nationals or one  of2 ~. S4 V  X- K- ]' G
whose parents is a Chinese national shall have Chinese nationality. But  a& ]+ u( g; `% ~1 ^
person whose parents are both Chinese  nationals  and  have  both  settled. E: X) J) L) }/ B
abroad, or one of whose parents is a  Chinese  national  and  has  settled  L, C" Q7 @4 ~  j
abroad, and who has acquired foreign nationality at birth shall  not  have# o! i& m5 J' _" G5 _, H
Chinese nationality.) i/ O% ~# i6 c" f
Article 6
' y5 }1 x! ^, p6 y0 ~8 I' a( }Any person born in China whose  parents  are  stateless  or  of  uncertain1 B' ]" t4 d6 M
nationality and have settled in China shall have Chinese nationality.

4 K1 D& B+ y; M+ uForeign nationals or stateless persons who are willing to abide by China''s" D6 _5 \/ T2 p9 S. p8 A1 c7 Y: s
Constitution and laws and who meet one of the following conditions may  be
; }0 G3 c% p% ?# @0 ~5 S9 U1 Cnaturalized upon approval of their applications:9 R! o7 M3 E( h
(1) they are near relatives of Chinese nationals;: E! U8 J1 G( G0 w- c8 ]/ M
(2) they have settled in China; or
; X- e" X3 G; S7 u6 K; Z5 V(3) they have other legitimate reasons.0 s! o$ p# `) x- ?
Article 8
+ t# L* x1 d" \+ Y  s8 Z5 r" WAny person who applies for naturalization  as  a  Chinese  national  shall* k5 Y7 j) l0 v2 d9 B3 k7 e
acquire Chinese nationality upon approval of  his  application;  a  person
+ I8 \( @/ u# c; i$ ^, R3 W: d. {9 cwhose application for  naturalization  as  a  Chinese  national  has  been  a9 g) ]# f4 ?  T' Y* X% H% D
approved shall not retain foreign nationality.
9 q6 J  I5 E) _9 wArticle 9
0 w2 i# Y6 Z) v9 |0 ]Any Chinese national who has settled abroad and who has  been  naturalized4 Z- Y7 k/ `" o( A* d# \9 r) F; j0 B: |
as a foreign national or has acquired foreign nationality of his own  free
. F. @$ b$ p9 c( y3 `will shall automatically lose Chinese nationality." e" `3 g$ C: _2 ?
Article 106 s2 [# k6 U0 Q. C
Chinese nationals who meet one of the following  conditions  may  renounce
; I0 d2 t% c* YChinese nationality upon approval of their applications:) a" Y+ N; a6 S4 }' s6 J
(1) they are near relatives of foreign nationals;2 ~+ u0 e" ?/ A5 {4 _0 p$ f- Y$ h
(2) they have settled abroad; or
# l4 f" @* ?0 C" v2 T(3) they have other legitimate reasons.
7 W" B/ o2 D6 O, bArticle 11. `$ I' V1 U- o* w3 B
Any person who applies for renunciation of Chinese nationality shall  lose; k) D0 K& ^8 G/ N1 F
Chinese nationality upon approval of his application.
3 P% a% A9 v6 e) W* ~& _Article 12
& \8 S* ^7 y; \3 @8 n0 q  cState functionaries and military personnel on  active  service  shall  not
2 e7 r0 E9 ?, c! S& q; ^  Y$ y- h3 qrenounce Chinese nationality.4 w6 D4 \" V; j& O6 k! O
Article 13: I( ^2 V8 k4 C6 E0 M  l
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for0 `: b% w5 G! q. H6 A
restoration of Chinese nationality if they have legitimate reasons;  those6 O$ B- S" ?0 z$ l0 q& U- D: F
whose applications  for  restoration  of  Chinese  nationality  have  been
# L. B3 ?+ F& v6 _5 w8 Fapproved shall not retain foreign nationality.
2 o" k, }/ b3 O" z- oArticle 14( _1 \4 C. S! j9 Z$ p
Persons who wish to acquire, renounce or restore Chinese nationality, with5 `+ z' Z" c3 [
the exception of the cases provided for in Article 9, shall go through the
' p/ s& ~4 g, h- [8 i9 P3 kformalities of application.  Applications of persons under the age  of  18
( q* k4 x( |  T4 I+ }0 n5 F$ jmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
7 J2 o/ y4 P/ m, G8 i  krepresentatives.
# x5 O  o* g/ Y" E6 MArticle 15, R' e9 W) u! N% O
Nationality applications at home shall be handled by the  public  security
# m3 j8 b" ]8 ^9 ebureaus of the municipalities or counties where the applicants reside;/ G0 c( ~( e# B% z
nationality applications abroad shall be  handled  by  China''s  diplomatic- E9 C7 e( K3 t( Z3 h
representative agencies and consular offices.' ~; t, M' f9 U
Article 16% u/ a. l/ {* ^$ O( X5 O" q8 o
Applications for naturalization as Chinese nationals and for  renunciation  i" N0 o* d/ E0 H0 k( |/ ~
or restoration of Chinese  nationality  are  subject  to  examination  and
& l: L. T- \( p9 ~approval by the Ministry of Public Security of the  People''s  Republic  of! X$ I" O/ B3 \" b
China. The Ministry of Public Security shall issue a  certificate  to  any
+ u4 q4 N% W; S3 w0 \) x$ @' p* aperson whose application has been approved.
- j- S+ O# s* TArticle 17
- d& e+ x+ B; U) B# nThe nationality status of  persons  who  have  acquired  or  lost  Chinese5 z1 h/ }/ `/ m
nationality before the promulgation of this Law shall remain valid.
6 _% t/ H& }( F. e2 n5 BArticle 181 u/ N' P. C! s5 l  ?8 T! ]7 Y
This Law shall come into force on the day of its promulgation.
