第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
. [6 j4 {0 g% |9 _$ ~3 a$ A6 G# `2 y 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
, Y1 Z' f: g+ t; f, \. a 第三条 中华人民共和国不承认中国公民具有双重国籍。2 C# D: M5 n7 e n, R
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, K, U0 i5 }9 ?) `; c 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* }3 x* S" ~" ~# d/ A; o0 w, q
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
7 ?! O8 ~# e5 `5 } 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
/ n: U& c5 @8 N& Q) d 一、中国人的近亲属;; m: [2 k: H1 N V$ e9 H1 k
二、定居在中国的;
2 l/ J8 r. J8 X4 y 三、有其它正当理由。
0 F$ [1 I* @( z ?- I: F/ b- w 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
' l4 |4 }2 k) O& Q# Q. z6 Y O& q 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
" y! W4 |8 G8 G1 p) k P$ v 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:" s+ X" W+ P8 s7 M# J. k& i
一、外国人的近亲属;
/ _! P! }0 b2 s2 J9 W 二、定居在外国的;

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。4 d; y$ T- l2 ]+ {
第十二条 国家工作人员和现役军人,不得退出中国国籍。+ d0 U; `" P: D x
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。2 l. S5 d' F# u Q3 F/ W( I
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
1 l6 f! k- F5 F9 d0 g+ k# _5 L) w 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
4 s* J4 }, }$ w 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( v- t$ v# P0 W0 } 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。# p$ f/ n; z8 p3 `

This Law is applicable to the acquisition, loss and restoration of

The People''s Republic of China is a unitary multinational state; persons
6 I/ l: h/ }# Z# O# n& Mbelonging to any of the nationalities in China shall have Chinese

Article 3
2 s# w$ k {* X+ m) ~, f" @The People''s Republic of China does not recognize dual nationality for any9 s8 R6 K, J1 j: k h. a4 V9 L* H9 ]
Chinese national.

Any person born in China whose parents are both Chinese nationals or one
) ]: y+ P( a# r @2 N- ]" B5 e& M0 Hof whose parents is a Chinese national shall have Chinese nationality.

# m- p& V6 M$ ?9 `Any person born abroad whose parents are both Chinese nationals or one of
& L$ U, h' f" U jwhose parents is a Chinese national shall have Chinese nationality. But a

abroad, or one of whose parents is a Chinese national and has settled

Article 6
& P) @: g6 e) \' D2 B; RAny person born in China whose parents are stateless or of uncertain: g# s/ }% F8 J+ r
nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
C7 [% R5 i! S/ I6 O( kConstitution and laws and who meet one of the following conditions may be
* _5 l8 e) F- O5 L, R. `naturalized upon approval of their applications:$ M9 b: Z, ? h8 ^8 l" L
(1) they are near relatives of Chinese nationals;
`4 c" a& x3 j% ?$ _(2) they have settled in China; or
# [: [! q3 K/ ~. W(3) they have other legitimate reasons.

9 W& f1 X' l2 M9 nAny person who applies for naturalization as a Chinese national shall
. h0 Y; x6 C2 {. G/ {( pacquire Chinese nationality upon approval of his application; a person
6 F5 A. l; o/ awhose application for naturalization as a Chinese national has been
% J$ }$ ?1 h4 c& r8 P4 \* Sapproved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
" _- S4 E; j9 K9 {. g, g. T, w7 cas a foreign national or has acquired foreign nationality of his own free+ g+ r# A2 q4 i( Q7 ~
will shall automatically lose Chinese nationality.* ?4 y) K( S: s8 L8 Z( O) F
Article 10# r6 a# \& K$ B' u3 E
Chinese nationals who meet one of the following conditions may renounce: T: B" x3 o4 K& D# D
Chinese nationality upon approval of their applications:+ L5 X- A" p! b a. p% \
(1) they are near relatives of foreign nationals;, ~8 e, U) u7 B& L2 b5 X
(2) they have settled abroad; or' x7 R3 t7 v1 @+ v1 O
(3) they have other legitimate reasons.

* H$ ]/ U0 b' Y) m t% F" iAny person who applies for renunciation of Chinese nationality shall lose+ V, L7 `: s; R+ F0 P
Chinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not3 B3 f( i4 @* \0 |; g8 n
renounce Chinese nationality.( o% {* d- a- t0 g/ l! n" J9 x
Article 13
D2 i& D! X, m9 ]3 p! P% Q2 a, T4 JForeign nationals who once held Chinese nationality may apply for
/ L% C. L7 p/ [( N erestoration of Chinese nationality if they have legitimate reasons; those
* b' ]% f1 k3 W7 c qwhose applications for restoration of Chinese nationality have been: |# \9 Z$ U$ J1 i* `$ H" t
approved shall not retain foreign nationality.
! H; g9 H' S( U! R5 `9 ?: BArticle 148 ?$ W7 Z# h$ @
Persons who wish to acquire, renounce or restore Chinese nationality, with7 a4 B* t1 ~# f
the exception of the cases provided for in Article 9, shall go through the
s' m4 l. |3 Z5 Uformalities of application. Applications of persons under the age of 18
: b5 C0 a1 L+ N$ |; s: L$ Zmay be filed on their behalf by their parents or other legal
+ W6 @& @. E0 n* I, A2 Urepresentatives.
- t( b$ z, l9 w; J$ @# U) W0 zArticle 15# c5 a4 O9 ~" v1 Q/ R# Q
Nationality applications at home shall be handled by the public security( |& t9 G; b4 h& p, c+ Z/ |5 z: z
bureaus of the municipalities or counties where the applicants reside;5 d2 j! I0 _# n/ C# Z
nationality applications abroad shall be handled by China''s diplomatic
) S# a" V9 y( v3 r ~representative agencies and consular offices.

Applications for naturalization as Chinese nationals and for renunciation+ Z% ]7 i s0 p( U! ?5 M ]' E
or restoration of Chinese nationality are subject to examination and
! S% x/ o# @2 O. happroval by the Ministry of Public Security of the People''s Republic of
7 V) |0 m. w8 RChina. The Ministry of Public Security shall issue a certificate to any) \" T3 n2 X2 D
person whose application has been approved.( ?3 E. j1 N3 G8 B0 W y0 L( x$ h Q3 @
Article 17
5 a' e* k# ^+ T$ zThe nationality status of persons who have acquired or lost Chinese4 k' s- a- o& t4 B2 M% c
nationality before the promulgation of this Law shall remain valid.
8 [( u `# q" d+ q$ S% Y3 p) ?Article 180 ]6 U4 i6 B2 z( a
This Law shall come into force on the day of its promulgation. |
