第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。3 {  T6 l9 d% n, T- D! i
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
( W  g/ b7 J8 o' r    第三条    中华人民共和国不承认中国公民具有双重国籍。" ]' K! o4 |0 A; n" Y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) u& e# Q9 [7 e" c+ L    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。3 T" @0 A+ t/ W' P, p& G
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。/ X9 o2 u( t7 T4 _. f! u
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

    二、定居在中国的;
: a: t  V( z3 K& m! y8 ~    三、有其它正当理由。' ?( q  w* w: A  I* o! i! a+ n
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。; U# a8 K: O7 t/ U4 s: r' ]
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。, C" x1 M& r- n+ x* G
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:1 D7 p+ P% q- Q. n, @2 L
    一、外国人的近亲属;5 }' n  B  C) D  ?$ |* h9 s
    二、定居在外国的;
. Y4 j6 V/ x  m) W# }    三、有其它正当理由。
/ E: H$ q7 [$ z5 t$ ]    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
  l* e, f, q: @3 K/ W    第十二条   国家工作人员和现役军人,不得退出中国国籍。5 S& T3 Q% f" G2 x: R8 I7 h+ b
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
1 F# X: Q  K) O8 q# S    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。6 A; j+ c' \- ^' d' Z* N0 H  Q$ I' S6 c
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
8 q, U+ h7 B# M    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。6 n8 z- K. k$ Z" Q! b/ X' ]4 X
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
7 w3 J; a& w% y: C. hThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of8 E: j# D5 A! Z$ h) U1 p# f0 A
nationality of the People''s Republic of China.
/ T: Z2 `" t' V! P  O/ I" E5 UArticle 26 s1 e: j- J' x) j% B$ K: O! b
The People''s Republic of China is a unitary multinational  state;  persons
$ D2 @1 I' {1 v& J3 Y) q, r' nbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese. _$ ?0 D. ?5 v' q
nationality.
$ I, D3 r9 W/ ^* xArticle 31 h$ ]6 m2 G- Y
The People''s Republic of China does not recognize dual nationality for any
2 J- w' e/ t, wChinese national.
' T( D2 K5 j: aArticle 4! X* ?9 T) @) N7 c
Any person born in China whose parents are both Chinese nationals  or  one
: t& G( ?& T- H+ X3 z7 S! i& Eof whose parents is a Chinese national shall have Chinese nationality.8 z$ S, ]3 P+ L! u( I+ p
Article 5
8 g6 x# b( v% d( p) @, TAny person born abroad whose parents are both Chinese nationals or one  of6 k# \8 j# u, @" s  G' q
whose parents is a Chinese national shall have Chinese nationality. But  a* |# U9 K& n& Y  ^
person whose parents are both Chinese  nationals  and  have  both  settled# ~- n: A/ G, D7 a8 |( R- ~
abroad, or one of whose parents is a  Chinese  national  and  has  settled! H% `" @  _8 V% v" {
abroad, and who has acquired foreign nationality at birth shall  not  have! n, K& }! w5 h! `/ E
Chinese nationality.
7 F3 Z: O  \# aArticle 6$ Q- f; M$ b- w# N8 X
Any person born in China whose  parents  are  stateless  or  of  uncertain
3 R: b$ R6 D- h8 C0 x9 N2 q2 anationality and have settled in China shall have Chinese nationality./ M3 y$ j$ p" z
Article 7
: J2 v; o) M% A# _7 C8 O  t: n- WForeign nationals or stateless persons who are willing to abide by China''s
' u0 O( M2 |. U& y& q1 {Constitution and laws and who meet one of the following conditions may  be0 H8 [+ k: D# V* {" V0 F' _
naturalized upon approval of their applications:$ m3 u* E1 W$ Q, o, U+ Q
(1) they are near relatives of Chinese nationals;
0 j* Y% l. O) }4 }' j8 [(2) they have settled in China; or
" i/ v1 O* |8 G; y0 n' i& l(3) they have other legitimate reasons.
4 Q; H3 k0 T; {( x# r4 wArticle 8
* n: Z% g3 X2 iAny person who applies for naturalization  as  a  Chinese  national  shall- ]% Y: D$ o7 K. D& X9 i" p* w
acquire Chinese nationality upon approval of  his  application;  a  person; Y! g; ]1 v$ y; C7 }; E
whose application for  naturalization  as  a  Chinese  national  has  been
( v5 u) h2 Q) K& F- ~4 ]( t7 sapproved shall not retain foreign nationality.
( I/ \" N2 y6 W9 U  VArticle 9
" }; V, T, Z! C$ @- ^( S) \  Q' b# R; OAny Chinese national who has settled abroad and who has  been  naturalized
; P* v$ I2 A; pas a foreign national or has acquired foreign nationality of his own  free
8 }) z4 L- v; K. d7 e% m2 ]- mwill shall automatically lose Chinese nationality.
. h2 e. w! x+ _Article 10
0 F( w6 y6 i' E. F: t2 C' |; bChinese nationals who meet one of the following  conditions  may  renounce
% {& c7 _  ]; `Chinese nationality upon approval of their applications:2 i! e: E$ ]# e- ^
(1) they are near relatives of foreign nationals;
& ~# I" S/ w7 [3 b) N(2) they have settled abroad; or% n3 }) I6 O  H
(3) they have other legitimate reasons.
5 `& L1 K& \3 m" l" VArticle 11
1 `" o& ?# @9 w/ K1 p0 XAny person who applies for renunciation of Chinese nationality shall  lose
, H6 k, q+ j2 u- bChinese nationality upon approval of his application.
6 {  ]9 W  g+ p. c5 x: k6 P6 }; K4 ^Article 12$ V. Z4 h% A# r, Y5 g
State functionaries and military personnel on  active  service  shall  not
% P; z  y  V' T4 E  w( Irenounce Chinese nationality.
1 s7 J8 H. g% Y& g1 nArticle 13. _) j; Y1 s1 ?1 P7 z
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for% W3 ~3 K7 D# `  [8 o0 ]6 b7 ?
restoration of Chinese nationality if they have legitimate reasons;  those
8 h2 X# Y/ n$ N, R4 A9 C1 D) e* ~whose applications  for  restoration  of  Chinese  nationality  have  been
' j3 [' q+ e6 _" Wapproved shall not retain foreign nationality.
' H' D4 s8 d8 d0 kArticle 14$ J! c  ]9 A" @% y# v6 O! R/ {& v
Persons who wish to acquire, renounce or restore Chinese nationality, with
5 H( C1 Q6 u: L6 `- N) {) lthe exception of the cases provided for in Article 9, shall go through the
) @9 x, t/ {% S1 p' i8 b. vformalities of application.  Applications of persons under the age  of  18. `' ?- i+ R4 E- G7 H# _0 W
may  be  filed  on  their  behalf  by  their  parents   or   other   legal# m8 A' Z+ V7 }! e* x
representatives.
( Q- ?! o% v6 q) |1 s5 O6 V7 rArticle 15
7 l  I* U5 T7 w/ R4 rNationality applications at home shall be handled by the  public  security5 \1 H* S/ z' h5 W) b+ Q3 c
bureaus of the municipalities or counties where the applicants reside;
3 \2 Z4 B( f  z# cnationality applications abroad shall be  handled  by  China''s  diplomatic
2 Y; L  t* |' I- [& brepresentative agencies and consular offices.
( w) p/ Y5 V. B3 j. OArticle 16
7 B9 K3 N6 J7 x3 y7 jApplications for naturalization as Chinese nationals and for  renunciation2 z% _  G3 q8 Y6 p; s
or restoration of Chinese  nationality  are  subject  to  examination  and' ]& R! O* e2 c# c! o
approval by the Ministry of Public Security of the  People''s  Republic  of
" N, _7 y0 g; m3 I( ^China. The Ministry of Public Security shall issue a  certificate  to  any7 g; z2 b; w+ J- D3 c+ J4 l. g
person whose application has been approved./ g% ?  m: d8 s9 s' ^
Article 17
& z% ^& U$ W1 m% C7 `* qThe nationality status of  persons  who  have  acquired  or  lost  Chinese
! p6 \4 b$ H% D' C/ h  t3 d7 q* tnationality before the promulgation of this Law shall remain valid.
. P0 A7 a3 b- H9 z+ d$ Y  BArticle 180 e) ?3 G% o3 ?" v3 N
This Law shall come into force on the day of its promulgation.
