第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
6 [1 q+ B( M, q$ l 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。4 c. M: M6 f! g. H6 f/ U3 J8 o
第三条 中华人民共和国不承认中国公民具有双重国籍。
# K: [9 D. l( Y 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。' v) J4 D% n$ Y5 N; k8 M9 ?& B
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
@$ a! t* `: G8 B* h 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
; G: C; V6 s) g% T* J& q/ H 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:0 P' r$ |5 k4 I7 F# s8 N0 o% M8 [! h
一、中国人的近亲属;7 |1 M9 C4 e' c( f/ D/ {
二、定居在中国的;
( W3 h; |& v2 k! }& c 三、有其它正当理由。
$ [& P8 X8 V+ Y6 B4 I- ? 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
8 A3 m* c/ f4 p! M2 H1 B 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
. f2 V9 R- ~8 u5 ~! a' {5 f 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。, D( R, K0 j- X7 [
第十二条 国家工作人员和现役军人,不得退出中国国籍。+ g( W6 y7 v7 i( [ H3 C! ~
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。 a8 N. z+ ]8 a
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。& N" u% i/ V( r* f* e% n; U1 ]2 B
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。; H8 ?- A4 {2 h' J
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

nationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons6 ^+ n2 D: b8 E+ y& Y1 l% k
belonging to any of the nationalities in China shall have Chinese6 S# E, S( h* _- I4 ~7 {
nationality.

The People''s Republic of China does not recognize dual nationality for any

Article 4( N' @& G3 \; o2 A
Any person born in China whose parents are both Chinese nationals or one
% D/ Q4 m8 O$ ]- Y" l# y6 gof whose parents is a Chinese national shall have Chinese nationality.; f/ F- B) r" U7 M; ~0 W4 \
Article 5. M2 I/ R1 N) g. i9 N# E5 O
Any person born abroad whose parents are both Chinese nationals or one of& Z' Q! Q" t4 G/ r% O
whose parents is a Chinese national shall have Chinese nationality. But a
0 w) i# D+ }! Q- n# ?5 o" Q* _person whose parents are both Chinese nationals and have both settled, X/ T) w, }6 [! E+ @& L' O
abroad, or one of whose parents is a Chinese national and has settled8 H9 E8 @5 `& G5 b8 R* l$ I h8 P
abroad, and who has acquired foreign nationality at birth shall not have/ u+ n' x& P" N! U: p: Q9 k. i
Chinese nationality.

5 i) c2 Q; l3 @9 d% Onationality and have settled in China shall have Chinese nationality.

. w6 P2 u* l" O l+ V cForeign nationals or stateless persons who are willing to abide by China''s F; l2 B9 Y, A0 ]; u6 a
Constitution and laws and who meet one of the following conditions may be
8 Y7 V/ m9 u) J% O. d1 {7 Znaturalized upon approval of their applications:
% U: f% y$ p# \' j& R(1) they are near relatives of Chinese nationals;8 g# j8 I7 X+ P2 z' u
(2) they have settled in China; or
6 V0 [- Q( m+ R' A' x* i8 Z0 i(3) they have other legitimate reasons.

9 E7 N! ~8 D3 {8 f* U7 T" pAny person who applies for naturalization as a Chinese national shall6 w1 q1 Z+ L' s, u: F
acquire Chinese nationality upon approval of his application; a person
! U0 T7 O5 Z% h2 Q, B& M4 A; g( twhose application for naturalization as a Chinese national has been, T' }$ C* P) C* q
approved shall not retain foreign nationality./ v3 i5 X! Y' I- _' I

Any Chinese national who has settled abroad and who has been naturalized7 I& b9 T9 s- i. a+ K
as a foreign national or has acquired foreign nationality of his own free
4 p3 k* F6 Z% }+ g! `. D: Z" I# zwill shall automatically lose Chinese nationality.8 ?' t# m$ O5 U& \: X) {
Article 108 ^) e0 }$ o% T/ L* Z
Chinese nationals who meet one of the following conditions may renounce
% P9 E! o1 l4 |" K( {Chinese nationality upon approval of their applications:) ?& t, p$ X C3 a) I: Q% V
(1) they are near relatives of foreign nationals;7 C/ `' @# v1 {7 {# u5 \
(2) they have settled abroad; or7 [0 O w8 {. J3 t
(3) they have other legitimate reasons.' i1 O i7 Q# q" w8 w/ F1 W9 B( P- D
Article 11* g S6 r; B4 ^) x% a0 |
Any person who applies for renunciation of Chinese nationality shall lose
' i+ y, w% [7 t$ s5 o+ v& o: {Chinese nationality upon approval of his application.$ J& ? j- C8 P% W* q
Article 120 I8 \ V8 B( @7 B* L% A# w
State functionaries and military personnel on active service shall not
' J% P% V2 c/ s2 B) M' i$ Frenounce Chinese nationality.

* T S! C* |2 U) ^( t) bForeign nationals who once held Chinese nationality may apply for
7 \4 C4 S! g+ q/ U; l; {restoration of Chinese nationality if they have legitimate reasons; those
# F6 g u0 W, y2 w% U- D, S8 [4 xwhose applications for restoration of Chinese nationality have been
* b' ?- d9 d( t8 ]; m" zapproved shall not retain foreign nationality.% U% ?5 _( P( w/ `- e, f
Article 147 O* U1 P, ?, q
Persons who wish to acquire, renounce or restore Chinese nationality, with4 M' c7 [$ Z7 P# D& q# {
the exception of the cases provided for in Article 9, shall go through the
7 S. t8 `9 w+ Bformalities of application. Applications of persons under the age of 18! o$ U% F) x4 r) ^
may be filed on their behalf by their parents or other legal
]! H i K/ K/ J5 lrepresentatives.$ b( Y: B, T1 O1 X- F) }$ O
Article 15& D- b8 `$ a$ a3 L
Nationality applications at home shall be handled by the public security
$ B% E. ?4 S. M7 Z. `bureaus of the municipalities or counties where the applicants reside;' S: l/ t' O2 d; G
nationality applications abroad shall be handled by China''s diplomatic6 {' }- `, y7 Z& M- T+ E$ f
representative agencies and consular offices.2 I; w7 G! y3 }8 y3 J6 v/ D
Article 168 c1 q) ]4 @0 ~/ q8 [! F! g, \7 Z
Applications for naturalization as Chinese nationals and for renunciation! R8 w- [1 N9 V. d0 t: U* ~
or restoration of Chinese nationality are subject to examination and
' u% ~- X! A% ^8 Kapproval by the Ministry of Public Security of the People''s Republic of
8 J5 Z1 H1 ~. N( I( y) HChina. The Ministry of Public Security shall issue a certificate to any
% j9 g/ ^4 w* R5 t V u, P9 Xperson whose application has been approved.

! c" b/ f0 t1 D0 q! Q! c* P; n' zThe nationality status of persons who have acquired or lost Chinese0 F; {4 f7 I4 Y. i4 E. Q: k
nationality before the promulgation of this Law shall remain valid.
