原来加拿大雇主无故开除员工(dismissal)是合法的

我问了 labor law他们说 雇主无故开除employees是合法的

呵呵,这个问题还用问吗?既然是雇佣关系,那么解雇有没有原因根本不重要。。

如果是因为歧视,是可以打官司的。但是很难证明。其他的想怎么解雇就怎么解雇。& `6 r( s: H" y' q& _# }

这是wrongful解雇的四个原因,引自危机百科。  H5 v& z( ^$ `* c& B4 P+ }% N3 K
    Discrimination: The employer cannot terminate employment because the employee is a certain race, nationality, religion, sex, age, or (in some jurisdictions) sexual orientation.
9 u$ _( A2 r  R    Retaliation: An employer cannot fire an employee because the employee filed a claim of discrimination or is participating in an investigation for discrimination. In the US, this "retaliation" is forbidden under civil rights law.

其实原因什么的没必要问,理由多得是,比如公司经济不好需要裁员。
0 x: R9 m" m1 t4 {6 h5 z4 [唯一的区别是,公司正常lay off会给补偿金,失业者可以拿EI等;而fire就什么都没有

非也非也。。Dismissal也要看情况,通常只有Quit才99%没有EI(即使是Quit,有时候是因为雇主造成的,也有EI); h6 c+ h8 @* ^

我公司雷人也没补偿金
