not do any of the following:8 q" a) L9 E, [: m8 F0 @
(a) drive a motor vehicle on a highway unless the motor8 H4 Z3 ~( T: G$ \
vehicle is an insured motor vehicle;
0 K4 z- r, }4 F+ Z(b) have a motor vehicle on a highway unless the motor
5 t2 |" m1 N8 }9 @, D; Zvehicle is an insured motor vehicle;" [: f4 C( ~7 R# d3 Q! L) ^. x
(c) where a person is the registered owner of a motor vehicle,
& [) |8 ] Q( |3 v) b, Bpermit another person1 O" ? @: B, h% ^
(i) to drive the motor vehicle on a highway, or9 u) }& p! p+ r D3 L' A5 G! m
(ii) to have the motor vehicle on a highway,
' Y9 p) {% L( {/ [unless the motor vehicle is an insured motor vehicle;
4 k( c9 \- `5 I, L(d) give or lend a financial
6 s) L3 j7 [% \3 G" n$ ?responsibility card or a copy of it
, E- h& B3 M0 B( C( \* m- _+ Rto a person not entitled to have that financial
7 p) p4 C3 b9 S) u1 G, Y4 e) n9 ?! Vresponsibility card or copy.
" s4 Q" ?2 X/ o8 _+ V(1.1)% \: g3 U/ d4 v Q% B
If a person drives or has a motor vehicle on a highway! w7 ^; f# k# E2 b
without the expressed or implied consent of the registered owner of( s5 j) P. R6 D6 Y% P% S
the vehicle, that person is deemed for the purposes of subsection1 a; t2 y+ M; _3 ]$ _# g1 ?
(1)(a) or (b) to drive or have on a highway a motor vehicle that is/ `) O: U8 h7 @9 G
not an insured motor vehicle.6 k3 T: x6 @8 Q# R2 ~, \
(2)* z' y7 C; n- t5 Z8 v, v
If the registration of a motor vehicle is suspended under this
s3 {$ v8 o. c& k/ KAct, the motor vehicle is still registered for the purposes of this5 R! E/ }* M9 S$ p$ h" k
section.
! H, k; H3 w7 T& y7 b0 p7 U(3)$ e' L: ^! l( j B+ z
Subsection (1)(a) and (b) do not apply to a person to whom a
1 u# | W- w! w# V; s! jfinancial responsibility card has been issued pursuant to the$ S0 j8 E- e, z4 ~+ P+ S( V+ y
Insurance Act9 U; [: t5 x- f; b6 ^* K9 F, c
by an insurer who has issued an owner’s policy" q+ ]( y7 q) d( l2 }( N2 a
outside Alberta.
1 r4 \2 X8 }/ _) G) d# W" K(4)& w5 L. @! P. T' ^0 L1 Q
A person, other than a corporation, who contravenes subsection
6 Q, S" y- x; q$ n3 \5 e0 @* M(1) or section 52(1)(h) or 167(8) is liable,
! `" w2 y" o8 `4 u5 b! k: g(a) for the first contravention, to a fine of not less than $2500
( c; g( T' t) qand not more than $10 000 and in default of payment to
" K) _# r5 p* L t ~! Pimprisonment for a term of not less than 45 days and not8 I* H. m+ \) Z* n" R
more than 6 months
. o+ k2 F3 q4 R0 z1 XMinimum $2500, if you don't pay, you will go to jail for a minimum of 45 days. |
