第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
1 {" n. `0 X, ^. t0 J, r: C* i+ T+ P 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。7 ~0 y4 s, U. Q+ I6 Z: p g( ~9 x
第三条 中华人民共和国不承认中国公民具有双重国籍。
3 z; Z, S- F! `) V' w( D 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 c6 C1 l" C" e% N 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。: w$ j, ^+ c" ?' x
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。0 o! @/ C# @- Q/ L0 a6 A
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:, u; ]9 s# V; H7 I1 B

二、定居在中国的;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。: g( A. x. {9 m8 l
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。* U- N0 |) x1 F" u( I/ p1 U) }0 X3 G
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
# I. i6 X, e$ @5 |: u5 s7 j 一、外国人的近亲属;
( N) M- N3 q( d) S6 Z 二、定居在外国的;) L& H3 |- q2 p( D
三、有其它正当理由。
$ a7 L+ l% A2 z0 T$ \5 H 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
$ o4 d& i5 e. u3 d+ F 第十二条 国家工作人员和现役军人,不得退出中国国籍。
6 T& [' E) i- q2 @ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。" l* F+ Z# p& k
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
. D6 ~, d& Z! R7 T3 i, n 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
4 r' W c. Y* j$ L 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。3 l6 \' k; B9 [1 a) M% k, T) P
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is applicable to the acquisition, loss and restoration of: O" c+ L7 g, `) ]
nationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons! f* a( `$ k$ }- ]( F4 x
belonging to any of the nationalities in China shall have Chinese

Any person born in China whose parents are both Chinese nationals or one
/ h: z0 V, t' mof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of) d9 D" H/ Z- m2 l1 X
whose parents is a Chinese national shall have Chinese nationality. But a1 H5 c$ b9 @& i# |
person whose parents are both Chinese nationals and have both settled
0 F1 s, p( {- |2 R: p! ?& n/ Xabroad, or one of whose parents is a Chinese national and has settled

Article 6

Article 7
- i) A5 l# Z7 ?. w# PForeign nationals or stateless persons who are willing to abide by China''s
& p- }7 n4 n3 NConstitution and laws and who meet one of the following conditions may be8 A6 q$ ?6 ^. V2 F
naturalized upon approval of their applications:
; g6 m+ U8 x% I& b& z! Z9 Z) q(1) they are near relatives of Chinese nationals;" D7 } I8 G* w- k4 w
(2) they have settled in China; or
% d# ^4 U# `; a+ g(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall% G4 A" b5 L) F
acquire Chinese nationality upon approval of his application; a person% V5 M7 |, {, N( D$ S8 b
whose application for naturalization as a Chinese national has been
5 l$ X' Y9 c9 Y% japproved shall not retain foreign nationality.: i/ k3 L' {& H* [' V( L% V& Q
Article 9* J7 f' R2 o4 \% E* R
Any Chinese national who has settled abroad and who has been naturalized
! {' Z' l3 U0 nas a foreign national or has acquired foreign nationality of his own free' Z8 [5 r1 W/ i: x9 y; \
will shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce& X$ G7 f" C' t
Chinese nationality upon approval of their applications:
7 W3 [* L9 K9 [/ W(1) they are near relatives of foreign nationals;
3 e, l0 y' A9 ^* ^$ h(2) they have settled abroad; or4 b3 v4 e3 Q, g5 ~; q, j/ R/ @
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose5 @1 c5 ^; n7 t
Chinese nationality upon approval of his application.6 W6 K4 ]5 F$ d1 X
Article 125 @- k& a, U' ^& `
State functionaries and military personnel on active service shall not
/ N; S7 Z, t; x; N$ D, o5 J; Irenounce Chinese nationality.+ R+ `. V0 G, j5 a; W
Article 13# j* A, D! a' F) [ n, k5 K
Foreign nationals who once held Chinese nationality may apply for
' p, \# W$ \9 Z4 ~restoration of Chinese nationality if they have legitimate reasons; those
) G9 g/ H6 r* M A+ S; ?! zwhose applications for restoration of Chinese nationality have been) k) @# J2 n" t$ n/ z7 R
approved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with
( g0 @, q- ~9 ~( K S( h1 |( Sthe exception of the cases provided for in Article 9, shall go through the
/ W1 k1 B% T- ?# Fformalities of application. Applications of persons under the age of 18$ }6 ?( q: W( x6 r+ Y" o% G0 @
may be filed on their behalf by their parents or other legal
' b) S0 J1 b n+ zrepresentatives.# ?' [+ x% W2 M. m' s
Article 15
+ ~8 g4 @& D* Z' l) X* h9 n' [* hNationality applications at home shall be handled by the public security3 v& Q& {# _, S9 U5 ?
bureaus of the municipalities or counties where the applicants reside;
9 `! Y0 m# L! _. L7 rnationality applications abroad shall be handled by China''s diplomatic" Y: F0 x6 S e; ]$ L
representative agencies and consular offices.; ?& J* }6 \; A: C& h2 E& k
Article 16- r5 l( r6 s8 M) Q1 q3 o5 y# a
Applications for naturalization as Chinese nationals and for renunciation
5 |- z7 x% t, W& r+ x- e6 x; Eor restoration of Chinese nationality are subject to examination and
5 p4 U b" [; W0 m9 y7 ?approval by the Ministry of Public Security of the People''s Republic of/ F7 h5 @1 P0 ~! w
China. The Ministry of Public Security shall issue a certificate to any
2 T; `9 v! \: {person whose application has been approved.8 d: D5 v& J3 b; q! K) l! U, y
Article 17. [) ~; q# k8 {8 d" k! v7 Q
The nationality status of persons who have acquired or lost Chinese
* r; m% _% J$ U4 B+ m3 V. Wnationality before the promulgation of this Law shall remain valid.
( U( g3 e' z7 y! {. f9 V+ gArticle 183 j6 J7 Y6 o' h1 y2 o3 _
This Law shall come into force on the day of its promulgation. |
