《中华人民共和国国籍法》 * W7 S  I6 F& l; S$ ]* m7 S( r( S
 
- H0 x% x3 K7 T9 Z0 I# c) H 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
% Z" V/ j- D  g% C9 B+ F! w    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。2 u  R" @2 k* W* b" R1 i% _- V2 z
    第三条    中华人民共和国不承认中国公民具有双重国籍。, ^  `7 p* ]1 M7 g
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。$ W+ r+ F$ }% r& J0 D0 b% p
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。" G) V  h* ~0 {2 I% ^2 \, {
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。% }; z, I, U" X* Y, z1 _7 s
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:. h3 P, s6 g0 a# J
    一、中国人的近亲属;
0 I1 k8 p7 r* q6 t/ ~  m5 c    二、定居在中国的;
$ c% W) X/ u) b2 G( M    三、有其它正当理由。
2 r2 u+ b: l# t7 d3 H# C8 J    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
% L! |1 b. v# V    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
$ v3 n, y/ q% T  r/ w1 h    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
. }$ l7 a2 W  f. K& M* Q    一、外国人的近亲属;" i' m8 n( m9 Z
    二、定居在外国的;
( a+ E2 I: N4 b% \/ X- J    三、有其它正当理由。
" W. K4 O2 F* p; V  A% ^3 E    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。: C% _; }3 Z' _* I+ O5 V1 C% V
    第十二条   国家工作人员和现役军人,不得退出中国国籍。7 z9 l2 u* y% E+ |5 ^
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 D' d/ ]- a; Q# ~
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。2 M$ x5 `: Q( [
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
( C$ h6 Z- D' p' A    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。* |( g; n: i( X# O/ _5 p1 l
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
# t$ `) x# c8 {9 i& m, `This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
2 j3 E) f3 g6 b" Cnationality of the People''s Republic of China.- a+ v* R) I+ ~- e! Z
Article 2
& N$ ^/ i, G/ J6 [The People''s Republic of China is a unitary multinational  state;  persons
# |" @3 h# G# C; h3 Wbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese4 \4 J: h) I0 i3 d1 ]
nationality.* Q% D( z7 Y. A9 ^  l! z4 Y: }
Article 3& s2 Y& U( R. S6 S. D. Z* d, s2 o6 U
The People''s Republic of China does not recognize dual nationality for any/ U3 f# y5 |. p' g' y( q; ~/ U
Chinese national.2 K0 i! t0 _  q8 N
Article 4
% V/ B' N  E- t/ P- o1 O' z$ kAny person born in China whose parents are both Chinese nationals  or  one
+ q3 A- G( z# a/ U  kof whose parents is a Chinese national shall have Chinese nationality.
' d, f2 b( [8 ?Article 50 F) l  N4 m' \8 c! ^
Any person born abroad whose parents are both Chinese nationals or one  of6 b" j# n# K8 N1 X1 P* ^
whose parents is a Chinese national shall have Chinese nationality. But  a
8 W8 X) K1 U/ M' f* Y# M3 L& b$ T9 hperson whose parents are both Chinese  nationals  and  have  both  settled( b  K1 d% {" H- `" [, ^5 b
abroad, or one of whose parents is a  Chinese  national  and  has  settled5 v4 b# j1 D+ o, k7 B4 A. N; W
abroad, and who has acquired foreign nationality at birth shall  not  have
& ]8 y" c$ ]: m! [. L8 OChinese nationality.
( M0 d' _) P/ z) v. lArticle 6
2 L- Y% S0 d- A' S! H7 FAny person born in China whose  parents  are  stateless  or  of  uncertain7 ]% P4 ?+ C' \
nationality and have settled in China shall have Chinese nationality.
. {. S" ]& C7 M/ kArticle 7! V: A8 g. s( ~) k, [: V
Foreign nationals or stateless persons who are willing to abide by China''s
+ O! U1 X+ D$ t/ T  [  fConstitution and laws and who meet one of the following conditions may  be8 C- H/ Q+ A. N0 O# v( D
naturalized upon approval of their applications:
0 @( j2 F  X7 C# ^$ R(1) they are near relatives of Chinese nationals;
7 u& P5 c0 e$ f8 g; l/ R7 W0 o(2) they have settled in China; or
% N, s# S& o: G) I(3) they have other legitimate reasons.
4 y6 Y0 ?9 T& n, ~* D, YArticle 8
( u% t0 Z" T0 d: w( b2 AAny person who applies for naturalization  as  a  Chinese  national  shall) u, e+ R# a  S! W) M! s
acquire Chinese nationality upon approval of  his  application;  a  person  L/ _0 O% q! L$ R
whose application for  naturalization  as  a  Chinese  national  has  been/ n1 D+ e  B4 p" j+ l
approved shall not retain foreign nationality.
9 `: ~+ e( k# X1 l+ b. Y. o' NArticle 9) o! b, I4 H2 V/ `
Any Chinese national who has settled abroad and who has  been  naturalized
5 g) H: T' v; R+ Tas a foreign national or has acquired foreign nationality of his own  free
0 @6 s8 D2 W1 r8 `: b" u# P- [will shall automatically lose Chinese nationality.
! D) R. |3 G6 a3 R: V/ I4 L: N/ OArticle 10
8 W/ S) v1 m. |) GChinese nationals who meet one of the following  conditions  may  renounce
( u) u% r# O( x+ A% {Chinese nationality upon approval of their applications:0 D1 J( _, M/ g6 r
(1) they are near relatives of foreign nationals;9 C' N' n. V% [* T5 l3 X
(2) they have settled abroad; or
0 Z7 w0 n  Y- b) B8 B7 T(3) they have other legitimate reasons.( e9 b& @% J4 j" ]( \% V& l
Article 11
: f/ J2 {/ |, H5 O2 V* [Any person who applies for renunciation of Chinese nationality shall  lose3 s# R: `$ O) {
Chinese nationality upon approval of his application./ V, }5 j/ o$ ?1 M! t
Article 12
+ a3 L/ d6 l0 ^% B- @8 k: @! f2 ^. aState functionaries and military personnel on  active  service  shall  not
$ @& U3 x- B" S2 y2 vrenounce Chinese nationality.
3 t7 u, \4 C' n2 f% B- O/ r$ S# @Article 130 E5 P1 @: H8 x
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
% ~" e3 c7 m" ?: M& ~( Z9 ^. ~7 c  Srestoration of Chinese nationality if they have legitimate reasons;  those
4 k( v: _/ z3 w, gwhose applications  for  restoration  of  Chinese  nationality  have  been
8 x7 o; R: w! ?+ f3 ]' A) O  Japproved shall not retain foreign nationality.
9 ]7 n' N3 h* c; JArticle 14; _) A1 U9 X* s: V, ]
Persons who wish to acquire, renounce or restore Chinese nationality, with
; |0 K$ ^, n0 [* {the exception of the cases provided for in Article 9, shall go through the) w" n* k9 w3 j7 D3 k! g$ j6 n! t
formalities of application.  Applications of persons under the age  of  18
$ g# C+ Z1 x; j  l0 ~8 `may  be  filed  on  their  behalf  by  their  parents   or   other   legal* E" T% r9 }3 e$ R7 s9 G
representatives.
- b) r; ]$ p- e3 T5 s3 z$ f# e+ {Article 15
; ~- i1 W- w/ h4 o' GNationality applications at home shall be handled by the  public  security* R' G& B. t2 X5 ~+ b2 o
bureaus of the municipalities or counties where the applicants reside;1 }" l0 a7 `/ X& g# m
nationality applications abroad shall be  handled  by  China''s  diplomatic
3 q3 G" U$ o+ q3 W  [$ S7 ?representative agencies and consular offices.5 g  \; U3 @# u& |5 h; r; M  ~' g
Article 16
  p- h/ f: U& b2 y3 I7 ~3 tApplications for naturalization as Chinese nationals and for  renunciation
! K, O) z0 d/ \) S0 Yor restoration of Chinese  nationality  are  subject  to  examination  and& w4 e# O; K/ o$ ]; o! _% W7 r- F
approval by the Ministry of Public Security of the  People''s  Republic  of  G6 N* C; N: k9 O6 F
China. The Ministry of Public Security shall issue a  certificate  to  any, U) [+ l4 b& g
person whose application has been approved.5 L% R8 J* j' `& I
Article 178 }' E" I. D8 O* O
The nationality status of  persons  who  have  acquired  or  lost  Chinese2 l; I1 j& V6 _. I) V
nationality before the promulgation of this Law shall remain valid.
5 _4 x, M4 K. S3 {Article 18/ _4 w5 d7 z' F# ?
This Law shall come into force on the day of its promulgation.
