; g" L: l- h6 f/ \1 ?+ n 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。# j& j5 Q- K9 T7 R7 j
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
+ t$ k# |5 s$ q* s6 i9 u1 Z- E8 w' Y    第三条    中华人民共和国不承认中国公民具有双重国籍。# A; _5 \* s" J& L4 i% m: g5 y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
" C2 K/ v6 l2 ?- c" l. @/ k    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
7 \2 y# O+ B! s6 n    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。/ _# X# t2 Q% F3 U" z; e
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
/ H/ Z* H9 `# X) y    一、中国人的近亲属;' w. t  U1 ]5 ^4 m( [
    二、定居在中国的;+ P1 f0 _0 ]1 G" C* z6 O; G
    三、有其它正当理由。
1 c! {$ b. l9 G; ]7 u    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。0 s- W/ I1 I6 `9 R
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。  f% X& x3 s! c) `5 O1 m
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:" h: Z* Y. y9 |$ A( t0 e$ W
    一、外国人的近亲属;
, s- u/ b3 i! f. N    二、定居在外国的;9 G8 Z# ?1 d2 ?0 y
    三、有其它正当理由。! P; C) G! [- [: x2 W
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
. I; J1 X2 @0 M( K    第十二条   国家工作人员和现役军人,不得退出中国国籍。
2 e0 J! _9 s% ?- h3 h9 @3 V    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。0 b" K- L( L; @2 n2 d
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。- c/ q4 ^+ P0 D# d% e% g2 T5 N
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。! o( X. j& G: |
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
" c0 I/ r' n' h8 O# Z6 c$ B$ ~/ ^    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。9 Q# m- t1 c7 X; H9 y, z0 {
    第十八条   本法自公布之日起施行。

6 f' y* h( T" m/ H3 o. AThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of! Y; {# A- T/ g% C1 e: ~
nationality of the People''s Republic of China.2 Q0 Z( _  Q1 d1 E. V7 d. o
Article 2" O/ a/ y; t9 e" W9 O4 @
The People''s Republic of China is a unitary multinational  state;  persons
7 a  Y1 \/ j- \- h0 c0 n: L5 p* Fbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese  [8 z' Z" l& k/ ?
nationality.+ I4 d( s5 Z3 z/ t# z2 L% {. r) J
Article 39 }6 H5 l3 d! g8 v  k; H8 x
The People''s Republic of China does not recognize dual nationality for any0 f" y; f+ K$ v3 ^; B) g
Chinese national.4 I8 }7 H$ P4 @1 B
Article 4% V1 c: W5 k- s9 M2 A) ~* O) [* h
Any person born in China whose parents are both Chinese nationals  or  one! \9 J5 Y( w; _" `. l6 B
of whose parents is a Chinese national shall have Chinese nationality.7 m  j/ U1 F. t
Article 52 U, r! ~7 J: J# _
Any person born abroad whose parents are both Chinese nationals or one  of: ^& _; }! S; K
whose parents is a Chinese national shall have Chinese nationality. But  a9 x; E4 [/ X8 ~0 e
person whose parents are both Chinese  nationals  and  have  both  settled
( P8 W. i, c9 dabroad, or one of whose parents is a  Chinese  national  and  has  settled# ?% U& U) U2 |5 e5 o9 a
abroad, and who has acquired foreign nationality at birth shall  not  have
- F9 r9 |% s, J& JChinese nationality.
5 o1 M% \1 A7 S+ b2 i- l+ K& wArticle 65 G- k8 ~; l+ O; ]) J, A3 X0 C
Any person born in China whose  parents  are  stateless  or  of  uncertain
7 [" u% q9 X  Unationality and have settled in China shall have Chinese nationality.1 e/ z  \) F* ^( C
Article 7' ?* j# ^5 s& Q  H5 a0 `8 b4 }
Foreign nationals or stateless persons who are willing to abide by China''s
' e  T3 h# q! y& W9 C# A* f& FConstitution and laws and who meet one of the following conditions may  be/ A# ]9 [( c) p" ]6 Q! \
naturalized upon approval of their applications:
- R4 W' {, h. d# c* L* ^; r9 ^(1) they are near relatives of Chinese nationals;# W' ?" P" `# c+ y4 r8 t0 Q# F
(2) they have settled in China; or
" U& ~* t- S4 _$ I7 k/ y(3) they have other legitimate reasons.. x: h& d" r+ Y1 T2 e
Article 8. Q  ^) X; P5 M9 G5 _7 W, C
Any person who applies for naturalization  as  a  Chinese  national  shall& r( d. S8 b9 p( @/ I  p8 t$ f
acquire Chinese nationality upon approval of  his  application;  a  person/ W( r  R3 |1 a% q' H) H
whose application for  naturalization  as  a  Chinese  national  has  been
, W: ?" g: r: Iapproved shall not retain foreign nationality.( E3 [1 R: H; L4 L0 H
Article 96 z: Z  t4 ]8 k3 ]- r4 N
Any Chinese national who has settled abroad and who has  been  naturalized: S4 K7 m) ^: Q
as a foreign national or has acquired foreign nationality of his own  free
$ L% J/ O. l7 {- `, Z$ A3 ^8 C  Bwill shall automatically lose Chinese nationality.
: U* j  h. e( Q5 o  dArticle 10
: k/ ]9 ]; p- F+ r2 oChinese nationals who meet one of the following  conditions  may  renounce
: j1 ?9 d/ R( l: J; g2 ~  ~# x, m1 G* oChinese nationality upon approval of their applications:0 Z. X0 Y# p5 F& m  L
(1) they are near relatives of foreign nationals;
7 `( h. O( V( Q0 K' d7 ~0 Q6 z(2) they have settled abroad; or
9 C5 ^' t; w, T) n# _(3) they have other legitimate reasons.& W/ @! u# N2 U8 I% ^, M# b
Article 11" L1 Y/ z5 _* S+ B( X7 p# j) b
Any person who applies for renunciation of Chinese nationality shall  lose
, x7 n9 I8 m% PChinese nationality upon approval of his application.8 X: R$ e. o$ c
Article 12
( I* S5 q7 }8 p3 Y* D- ^) JState functionaries and military personnel on  active  service  shall  not
* o2 T* U) L8 m6 krenounce Chinese nationality.
( C- v5 A! m" I  ?Article 133 N. `, H1 R/ y2 }+ g
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for3 i# @; Q: S! _; A9 K& U& j
restoration of Chinese nationality if they have legitimate reasons;  those& a1 {+ ~1 x* E8 n
whose applications  for  restoration  of  Chinese  nationality  have  been
6 w8 T/ J4 q- ]approved shall not retain foreign nationality., G9 t4 g* ~9 k
Article 14
: A( B7 G7 e* U% nPersons who wish to acquire, renounce or restore Chinese nationality, with- x4 g1 z! N  ~' H- L
the exception of the cases provided for in Article 9, shall go through the1 H, e. E9 Q( @* R: Z1 [! e
formalities of application.  Applications of persons under the age  of  18: O& H7 ]! n! l" g" A
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
$ k1 A% d9 J- R! N3 T0 Lrepresentatives.
  n1 l0 @  z2 x1 wArticle 15) l! X3 |9 P! h  z- B& _
Nationality applications at home shall be handled by the  public  security3 b5 P: v+ M! y4 ~
bureaus of the municipalities or counties where the applicants reside;
8 i. a# x$ O  rnationality applications abroad shall be  handled  by  China''s  diplomatic
: O' j; {2 J+ l4 W& ?4 d8 Yrepresentative agencies and consular offices.: ~% S0 n( B" D7 C7 j5 e3 p
Article 166 F- D- ]+ N9 a5 N
Applications for naturalization as Chinese nationals and for  renunciation( o# Z: g( V; {& \
or restoration of Chinese  nationality  are  subject  to  examination  and
: L4 U. k' y/ T) v! A! a' R1 n, happroval by the Ministry of Public Security of the  People''s  Republic  of# n8 c) O( W2 k6 A
China. The Ministry of Public Security shall issue a  certificate  to  any9 C0 [: n; F2 [& m+ a" a4 N6 o" A
person whose application has been approved.
4 D5 I$ w) _0 X' {2 bArticle 17# s% a: l) B) N/ Q, k5 U
The nationality status of  persons  who  have  acquired  or  lost  Chinese/ ]1 L  ]4 x9 p' i4 ^0 O
nationality before the promulgation of this Law shall remain valid.: Z  V- C. n1 N+ o* p
Article 18) n8 R1 i% ]) P
This Law shall come into force on the day of its promulgation.
