; ^, {7 b" d x( g 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" p2 A; F* L+ ?! K( i. j 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
6 V7 j) R" C. P, ^9 R5 t 第三条 中华人民共和国不承认中国公民具有双重国籍。: M( x! d: C$ W+ |' z
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。5 ?* B* {1 k) l3 C, q
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。) T7 `! i: M b/ i
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。! d: C; ]2 `; |4 f2 Q8 ^# T
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
' U: ~2 f' B; w# K3 f 一、中国人的近亲属;
w7 M6 z2 A5 v0 f8 C/ V" }1 M- x 二、定居在中国的;
1 Z" M, ~& Y3 b m1 f 三、有其它正当理由。- u# s3 a8 n) ?: r! w8 B3 d5 l# r
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。$ r8 n; S6 Q V+ d. _( G& a
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
& z1 Q% B5 u3 f/ H 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:' [7 X) G3 L, l- a, p2 R
一、外国人的近亲属;
- W4 N3 ~7 M+ k) ~+ J) U# S) w2 { 二、定居在外国的;% c: \% l% t1 d. ]9 O
三、有其它正当理由。: A0 ^' t' i" F% J; a0 x. ^, U$ o
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。: \/ V! p5 m( J7 ]9 M9 ?! u& \
第十二条 国家工作人员和现役军人,不得退出中国国籍。" B+ i) \1 E7 p2 M- ?5 c
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
& h) |$ A: p* A7 o$ U9 @ 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
) G/ c- e/ ?; E4 y% }, A! y 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 n, ~5 N/ |* f+ M! ]. H1 [ 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。% Y0 N6 ^" b4 X$ e3 u$ [
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is applicable to the acquisition, loss and restoration of! j; d; c" w% I _
nationality of the People''s Republic of China.

& T7 j# m: X0 H8 a9 I6 JThe People''s Republic of China is a unitary multinational state; persons
9 u( Y% F" p- e0 b Lbelonging to any of the nationalities in China shall have Chinese& O# l! M. ?3 v/ n- h/ s! p
nationality.

of whose parents is a Chinese national shall have Chinese nationality.

person whose parents are both Chinese nationals and have both settled

abroad, and who has acquired foreign nationality at birth shall not have

. b0 F: I) i' V! G# gAny person born in China whose parents are stateless or of uncertain
) _# @' W3 A* u! ]nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s/ ~0 P+ \, C1 I9 N; i7 e0 a
Constitution and laws and who meet one of the following conditions may be! h) @/ P4 O3 c& I
naturalized upon approval of their applications:
6 H% P* d, R6 x5 ~( b+ _# S4 m4 J(1) they are near relatives of Chinese nationals;
# l; Q4 p5 N! r* b(2) they have settled in China; or
3 Q: B7 r* W% D t6 q. B, X(3) they have other legitimate reasons.

9 T! y& C& ~' S8 U) `9 |Any person who applies for naturalization as a Chinese national shall0 I' w2 h7 J/ A
acquire Chinese nationality upon approval of his application; a person' t) y! @1 q- D
whose application for naturalization as a Chinese national has been
2 k8 a: _0 h8 n+ C# R' vapproved shall not retain foreign nationality.; j5 X0 a) _4 C: C/ B1 {. [
Article 99 q$ E2 t" S3 k1 E( u9 Q2 [
Any Chinese national who has settled abroad and who has been naturalized3 n4 z* K/ Q' [ v; R
as a foreign national or has acquired foreign nationality of his own free' U7 n( S- ]% }1 Y8 J
will shall automatically lose Chinese nationality.! b7 @$ F h' b& e3 H0 }
Article 10
% j$ v, T( B5 E/ JChinese nationals who meet one of the following conditions may renounce* p7 {7 r7 i7 h) j, `7 ^! G3 N" U
Chinese nationality upon approval of their applications:
5 _& |- O1 |! ^+ ^0 }(1) they are near relatives of foreign nationals;; U6 b' N4 f* s% T- [
(2) they have settled abroad; or' _% g4 j% h; e! h3 y
(3) they have other legitimate reasons.

6 j5 Z. t& U( Q( ]Any person who applies for renunciation of Chinese nationality shall lose' f8 V) g9 Q6 z- _+ c
Chinese nationality upon approval of his application.
; d1 q. w0 }, t+ k: H0 M7 |! VArticle 12% Q( j+ t+ q6 y \: `1 {
State functionaries and military personnel on active service shall not
: ^# w Z" h- R+ Irenounce Chinese nationality.
' f6 `5 P/ t% e) SArticle 13
# \0 ~% m! t( t2 H. x" d5 R' mForeign nationals who once held Chinese nationality may apply for
, \/ _9 o. [- v. j+ mrestoration of Chinese nationality if they have legitimate reasons; those
( y3 H8 t% J2 Y0 w1 }$ Mwhose applications for restoration of Chinese nationality have been
" u$ z# {- |4 |) q; }' Rapproved shall not retain foreign nationality., y7 f, M2 r1 c5 R3 I* v
Article 14
; j) y' E2 \8 G1 Q- t) UPersons who wish to acquire, renounce or restore Chinese nationality, with" p+ g- i1 X9 v3 s5 a S
the exception of the cases provided for in Article 9, shall go through the% \: `% z+ K' ?3 G8 c2 [
formalities of application. Applications of persons under the age of 18. _6 e; G" J9 O/ `/ x
may be filed on their behalf by their parents or other legal
$ {3 r: D- o5 n( }- l0 M' crepresentatives.- T% S1 B1 n9 `9 O& r
Article 156 N4 ^, h8 c( X7 Q( {
Nationality applications at home shall be handled by the public security
; x) H' r3 y$ c# Lbureaus of the municipalities or counties where the applicants reside;# t) y4 j9 [' c& P7 j& x
nationality applications abroad shall be handled by China''s diplomatic
5 i% [# g# u7 W. T8 j7 O- t; lrepresentative agencies and consular offices.

$ G8 L- R" o5 V' i! H) B/ U2 A6 X% xApplications for naturalization as Chinese nationals and for renunciation
. L+ M9 r. h, e* R* @# B5 H0 u6 por restoration of Chinese nationality are subject to examination and6 d6 y; d9 m! O
approval by the Ministry of Public Security of the People''s Republic of8 r- K4 t9 @/ O i" A! P
China. The Ministry of Public Security shall issue a certificate to any
6 |& p: X+ R" A1 ]' K6 wperson whose application has been approved.

. U% H; j& y2 ]* B, x3 D" R/ bThe nationality status of persons who have acquired or lost Chinese% Q; ]5 O1 E3 v% S) o9 e; d
nationality before the promulgation of this Law shall remain valid.
