- u. o+ |" ?! P% {; d7 _: I 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
/ E$ Z9 w$ I; d3 |/ ~ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。: [( L; H3 B, i( x/ [2 W2 Y) S3 ~
第三条 中华人民共和国不承认中国公民具有双重国籍。
3 U$ z" Z# N& R& L 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
$ | o6 w3 n( H! u- b4 l 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
/ \. H2 F8 E, Y: i+ K J T8 Z 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。/ m1 N7 Z+ J' K. E% `* {) K7 f
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;0 K; \% ~5 r; y9 E7 H
三、有其它正当理由。
, J9 e" C. Y y* ]+ q, T0 t 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
# Z9 S3 D$ s8 u 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
3 M2 _: p2 w z9 J2 Q) x+ ~ 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:- j+ B5 [8 C! e" d2 ` g" y
一、外国人的近亲属;6 ~. j$ b, Z7 j( }
二、定居在外国的;
4 F$ E5 `$ M( t0 Y 三、有其它正当理由。

第十二条 国家工作人员和现役军人,不得退出中国国籍。
- Z, ~% Y1 o$ ]; N! Z: d 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。& K. d+ V, Q+ K4 }4 b
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。5 |3 Q2 F0 n6 a" _ J* N
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
: d2 c4 n, a, |; p/ F 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
+ V4 s) X1 `# X( } 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。0 A' a9 D$ Q! H( r

This Law is applicable to the acquisition, loss and restoration of% t( J% b7 }( g7 q

nationality.

whose parents is a Chinese national shall have Chinese nationality. But a

nationality and have settled in China shall have Chinese nationality.

' a5 {0 f) Q, H# l! U$ rForeign nationals or stateless persons who are willing to abide by China''s& }" H* V x* |3 @, |4 }1 g" ]
Constitution and laws and who meet one of the following conditions may be
6 a3 }7 [1 ?+ D" I2 wnaturalized upon approval of their applications:
+ W" i) d( y) m" |/ x8 \+ E1 i* }" w(1) they are near relatives of Chinese nationals;
& i( Z# }# }# R+ Z3 q(2) they have settled in China; or
1 E" Q* P# S$ y, U. E- D(3) they have other legitimate reasons.
$ g9 N! s8 `& S& t, ^$ j2 ]Article 8# h1 P+ c3 g: Z! h& t
Any person who applies for naturalization as a Chinese national shall. X" E5 X3 [! S# j0 s2 D5 U
acquire Chinese nationality upon approval of his application; a person3 J7 y {$ R3 m0 o+ `5 z
whose application for naturalization as a Chinese national has been
' Q4 x7 s! l! L3 a2 ~& v8 sapproved shall not retain foreign nationality.
' B3 e$ M7 M" C1 z. E* P6 XArticle 9+ D1 a' `) ~+ F" q" h
Any Chinese national who has settled abroad and who has been naturalized
2 ]. K! [3 \4 r& {7 E, yas a foreign national or has acquired foreign nationality of his own free
+ r. z& t! T; D3 @9 P5 owill shall automatically lose Chinese nationality.) A" _8 _% e! l
Article 10
+ Z, H2 y2 K5 z( yChinese nationals who meet one of the following conditions may renounce; c! u& b$ E% G$ B) }! M
Chinese nationality upon approval of their applications:; g' b2 k1 P; g+ M9 E# W- ~" U, g" l
(1) they are near relatives of foreign nationals;
# x; V9 O* C9 Z9 W- u(2) they have settled abroad; or' l, e' t$ W5 g7 {1 \: N' p. {1 x
(3) they have other legitimate reasons.: I6 Q' i* |" }( m; U- h
Article 11
3 W7 {/ b9 n, O6 [- }1 {8 h/ J* gAny person who applies for renunciation of Chinese nationality shall lose% j. B: x# P0 Q# G* a* ]
Chinese nationality upon approval of his application.
& B; b1 v8 Z8 a2 [Article 12
( |: `6 O* _# m, l( ?( @0 bState functionaries and military personnel on active service shall not
, G$ C$ L; Q; a& d% V7 orenounce Chinese nationality.
! N3 d# F ]- x0 aArticle 13
( I( W$ e% a' d! T: G5 ]9 T) t: R# [Foreign nationals who once held Chinese nationality may apply for' P- T: n4 c- B# R1 j7 y$ m" W3 ?7 V
restoration of Chinese nationality if they have legitimate reasons; those' Y/ v. }2 p7 E" }8 W: l/ P
whose applications for restoration of Chinese nationality have been
% [1 G9 o( {' Y% N' ]2 X ?approved shall not retain foreign nationality.
0 F; o( S* ?) J% g UArticle 14/ I8 ^* h. f" C$ W
Persons who wish to acquire, renounce or restore Chinese nationality, with
% y( [3 j' g4 ^0 a6 R7 K' ithe exception of the cases provided for in Article 9, shall go through the; \8 m8 v6 U% L8 t( G
formalities of application. Applications of persons under the age of 18
: _$ y4 v; a6 r r4 Nmay be filed on their behalf by their parents or other legal& |7 d# x% U. D9 k/ E, Z
representatives.
* Y* B5 J& Z. B' s4 [Article 15
[. A C# ]; ]Nationality applications at home shall be handled by the public security
% s! H+ E3 a; g+ k# T& ibureaus of the municipalities or counties where the applicants reside;
+ _) z1 R& I0 f8 y5 inationality applications abroad shall be handled by China''s diplomatic0 P$ r! M& R( B( O ?9 N
representative agencies and consular offices.
" ?6 C' m/ k+ ]& k2 QArticle 16
- p' ]8 U7 X& }3 X/ hApplications for naturalization as Chinese nationals and for renunciation9 j% @2 ?& p# r$ P t1 b1 ^3 P
or restoration of Chinese nationality are subject to examination and
! Q2 _; }) A& d' u' c# Iapproval by the Ministry of Public Security of the People''s Republic of7 t6 m6 N* v5 `- I5 }
China. The Ministry of Public Security shall issue a certificate to any0 ^& G0 n# c% s
person whose application has been approved.
% |2 L# F/ Y6 g6 G9 oArticle 17
" x# k* s* F# L* P, O: R# ]4 e& aThe nationality status of persons who have acquired or lost Chinese
& R }$ _" i' l/ `7 ~& Znationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
