《中华人民共和国国籍法》

( w& ~9 c. u2 _, C" I. u 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。; l, w. L0 m; L2 n, n
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
/ q( X7 o, d. ^) p  N    第三条    中华人民共和国不承认中国公民具有双重国籍。+ R, |, v9 P0 ], @
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。  F) o3 s- `. m7 r
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。0 \/ w  m4 G" Z1 E$ d
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
$ G/ i) T% ^8 t3 v* T3 {, K* c    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
+ n/ A; N9 M; i$ L$ T    一、中国人的近亲属;) }8 N/ c, V% G9 k1 ]
    二、定居在中国的;
2 @$ ~7 d" ~+ C% A5 Q; j    三、有其它正当理由。
* g# H! ], H5 N    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
- @4 n2 G8 X% m1 \6 i1 N5 K    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。- l( N) c# I5 Q; `! X7 @5 M- Z
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% A2 {; b9 Q" n4 r; N1 z. k    一、外国人的近亲属;
* o1 _5 a4 u* ~1 N: H! L    二、定居在外国的;' c; s1 J; q; e: P/ i3 g9 b
    三、有其它正当理由。" c7 v; r3 `, Z7 J
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。7 M2 \3 k+ i& E  L& y" x) r8 J, {
    第十二条   国家工作人员和现役军人,不得退出中国国籍。  o5 ?/ t  G- k" A1 G
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。. |2 \$ B( |! Z& `8 e7 I
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。8 T7 G1 |% s* J# s& U4 F( g9 {+ \
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。. t& Y  A* [: f+ V7 a, h
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。- a; b; ~" i2 C3 R+ s2 y3 v: G
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。: {( J9 @: l' m- C6 T8 n' v
    第十八条   本法自公布之日起施行。

4 J% A+ g' k5 ?1 i/ b4 m, @; eThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
- a/ ~' r6 }9 Znationality of the People''s Republic of China.
# E1 B8 D# T1 {4 ^1 ^+ o: c; OArticle 2
# a+ a1 j; {9 Z, a' k- PThe People''s Republic of China is a unitary multinational  state;  persons- O: n$ k5 e9 ~6 V
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
3 c& R2 _- |( T% x( C4 x. \5 Ynationality.

The People''s Republic of China does not recognize dual nationality for any

Article 4# q+ k6 f  f6 @% F
Any person born in China whose parents are both Chinese nationals  or  one3 N" h0 X4 |# ?- S/ E! ^1 w# l
of whose parents is a Chinese national shall have Chinese nationality.! J4 |% n4 C% o) d9 C" F4 A. z
Article 51 i- l+ b9 d  l) r. K5 }+ [7 a. n
Any person born abroad whose parents are both Chinese nationals or one  of
8 |' @: v% @$ z1 \whose parents is a Chinese national shall have Chinese nationality. But  a+ b. |6 E0 \5 Z5 ^  I5 @
person whose parents are both Chinese  nationals  and  have  both  settled4 f( T3 J2 C' a" P/ [- X
abroad, or one of whose parents is a  Chinese  national  and  has  settled
  T7 h5 x- H5 j( u6 J# gabroad, and who has acquired foreign nationality at birth shall  not  have

Any person born in China whose  parents  are  stateless  or  of  uncertain; }" V8 k3 u7 j; o
nationality and have settled in China shall have Chinese nationality.! h, n+ H# R5 R6 r% t' i
Article 7( S  [4 o0 ^% }. j- q2 i6 q" S
Foreign nationals or stateless persons who are willing to abide by China''s) m/ p/ {7 Q7 F: p& d+ [
Constitution and laws and who meet one of the following conditions may  be3 K5 ~0 ?9 ]/ I
naturalized upon approval of their applications:
1 S- |) d7 n/ ]" L1 M(1) they are near relatives of Chinese nationals;) \0 s" M9 [/ v4 J2 z+ r
(2) they have settled in China; or
# [: X; V2 E3 ]( P7 i, T1 q" c! O1 b(3) they have other legitimate reasons.6 q! T7 _* B; N3 Z# f; K
Article 8% G3 N9 R4 z! }. q; Z( x
Any person who applies for naturalization  as  a  Chinese  national  shall+ M, f! N' s# E3 r4 _. u
acquire Chinese nationality upon approval of  his  application;  a  person1 V: Z1 F5 ~- p0 A9 V
whose application for  naturalization  as  a  Chinese  national  has  been
) c+ m5 g: x5 U  r2 q/ X3 kapproved shall not retain foreign nationality.
) }  x7 A5 T" v$ k4 OArticle 9
9 \; h0 @6 u& i4 A+ w$ uAny Chinese national who has settled abroad and who has  been  naturalized/ C! W) }, c) T2 V
as a foreign national or has acquired foreign nationality of his own  free4 K- F( s4 S; C* I/ C8 s
will shall automatically lose Chinese nationality.
8 Z# D3 \& F" }: ~& RArticle 10
: ~9 y1 ], w( g. ^$ V4 qChinese nationals who meet one of the following  conditions  may  renounce
& {6 j$ @) t+ V) I& o0 n" nChinese nationality upon approval of their applications:" F6 n: \% Z0 p  J7 i
(1) they are near relatives of foreign nationals;" O% y: l3 D9 {6 B
(2) they have settled abroad; or$ i/ R5 U* W8 s6 j0 z) `
(3) they have other legitimate reasons.
0 J7 O$ M/ i+ z( W- WArticle 11
2 V0 w$ H+ g$ u- L+ NAny person who applies for renunciation of Chinese nationality shall  lose
/ `8 }8 t1 m/ Y( }2 t! A  QChinese nationality upon approval of his application.
( R: O0 v- h/ O* ]+ W( YArticle 12
( ?) t6 Q& \  B/ d4 KState functionaries and military personnel on  active  service  shall  not
5 g! R/ Z( U1 Z2 j$ Jrenounce Chinese nationality.
1 t( H8 z( W2 u0 S0 w; w1 L1 YArticle 13
- S: q% [+ U( ]. x  s, }& OForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
8 k4 S" d  I* n6 orestoration of Chinese nationality if they have legitimate reasons;  those% |: t2 G( C( w) J
whose applications  for  restoration  of  Chinese  nationality  have  been* O. D- [+ W1 x  x" `: h
approved shall not retain foreign nationality.
; P* V2 `# J' Y" oArticle 14- H5 \9 e0 D  T" O* M6 w
Persons who wish to acquire, renounce or restore Chinese nationality, with
$ k3 O( W& y7 \8 ?- Wthe exception of the cases provided for in Article 9, shall go through the
/ g- F8 U* }# `formalities of application.  Applications of persons under the age  of  18' @  e% L# Z' [  g. v7 I1 m
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
/ x: h9 Z& d, ]. Nrepresentatives.
" C4 O) T% T- [1 H* F* y: IArticle 15  P  o7 k4 z' C2 B
Nationality applications at home shall be handled by the  public  security7 u. x+ x' Q. i1 t
bureaus of the municipalities or counties where the applicants reside;$ W8 m5 @+ T$ v2 t! e: h
nationality applications abroad shall be  handled  by  China''s  diplomatic
6 K1 m& v( T: k# srepresentative agencies and consular offices.
0 r0 r, c8 m& h8 P/ yArticle 16# D# O' Y; x, y! G
Applications for naturalization as Chinese nationals and for  renunciation
' z. I: H' S- U; v  [) Q/ Sor restoration of Chinese  nationality  are  subject  to  examination  and
  W5 q8 K0 D; A6 aapproval by the Ministry of Public Security of the  People''s  Republic  of# ~7 q; n7 R7 F  C' N
China. The Ministry of Public Security shall issue a  certificate  to  any
5 S$ @. ~: n  }person whose application has been approved.* o, G& B3 u7 F
Article 17
: k# B" r: Z, t' s8 N; _The nationality status of  persons  who  have  acquired  or  lost  Chinese
5 P/ r1 l, ~2 p" Mnationality before the promulgation of this Law shall remain valid.
! ^0 ^: o+ Z& ?# P& N0 |Article 18
1 \  ~1 I$ I" O. }. [This Law shall come into force on the day of its promulgation.
