Can I claim my mother as a dependant on my tax return

Sorry guys, I can not type Chinese for now.
My mother stayed with me during the whole last year, carrying a visitor visa. I am married with 2 children. Can anyone kindly let me know that if I can claim her as my dependant on my tax return. Thank you for you time.

可以。但你一定要有战斗到底的决心。我父母和我一起生活了二年。原则上，他们与我一年内住满181天，我就可以申请他们作为我的DEPANDENTS. 2007年的报税，我历经了两次APPEALS, 才在今年二月份拿到了ASSESSMENT. 政府补给我大约二千块。不好意识我的最大缺点就是较真。估计今年没有精力和他们打官司了。

Why not?

As long as your mother's age over 65 and living with you more than 183 days during the year.

Thanks to all you guys, I truely appreciate your reply. My concern right now is lack of any solid proof that she actually lived with us during the year. She is not very active in any community life, instead she prefer sto stay at home taking care of the kids. What I can think of that can be used is a copy of her visa, and maybe a letter from the neighbors, if the government inquires.

"Jin Ye Wu Mian"...did the government request prooves from you that your parents acutally lived with your?

In my opinion, staying in Canada more than 183 days in a year is deemed to a resident of Canada for tax purpose. you can claim the Caregiver amount for your mother. Don't worry about the proof of the living with.

是的，他们要求三封信，邻居，同事和房东证明我的父母与我同住。加拿大政府做事还是挺拖拉的，但还算讲理。

请问您的父母超过65岁吗？有没有申请移民？
我问税务局的时候，他们根本没有问我父母多大年纪，只是告诉我因为我父母是visiting,并没有申请移民，所以不可以作为dependent

我父母是38年生人(71 岁）。没有移民。他们不喜欢加拿大。税务局的人强调字眼，不要你说“VISITING" (在英文的意识就是看看你就走了），而说”LIVING". 税务局的人，特别是电话接线员并不知道每一件事。你要求APPEAL后，会有更专业的人同你谈。但反反复复需要很长时间。若不是今年报税，我都忘了他们还没给我NOTICE OF ASSESSMENT.

我不同意你的说法，如果我没道理，再有时间去较劲也没用。可惜今天不舒服，后天给你找例举，等着啊，一条一条的呢。希望对大家有帮助。在加拿大有理走遍天下，无理寸步难行。嘿嘿! 开玩笑的。我后天休息，再查那些条条款款的，应该是他们在税法上的漏洞。

As Perry2009 pointed out, I think it is perfectly reasonable that one can claim tax benefits for the familiy member he/she supported to live in Canada if that person is a resdient or a deemed resident. It make sense in a way that you are contributing to the community econamy. It make even more sense for deemed residents as in general, these are the groups of people that are not qualified for any social benefits.

这的水真大，我找了半天才找到这个帖子。汇报一下进展情况。因父母与我同住，我电子报税的时候将它们CLAIM为我的DEPENDANTS. 今天收到税务局的来信，基本内容是让我提供 APPROPRIATE PART OF SCHEDULE 5, DETAILS OF DEPENDANT。还要提供他们的"VISA - A VISITOR'S PERMIT (TEMPORARY RESIDENT VISA)", 其实他们已经列的很清楚了，VISITOR 是可以CLAIM AS DEPENDANTS的。但同时要提供他们什么时候开始和我住在一起，住了多久。因为有了去年报税的经验，我的邻居和同学已帮我出了三封证明信。把这些资料发给他们后，就慢慢的等消息。去年的经验是，他们回复我不可以CLAIM，因为父母不是RESIDENTS. 我要求APPEAL, 最后成功。希望他们有了我的RECORD, 今年可以简单些。希望对有父母来访的家庭有帮助。

In this case, does it still matter whether if the parents are 65 years old or older?

My mom is only 51. We are planning on having her visit us and live with us for a while, probably over 6 months. If this happens, am i eligible for claiming her as my dependent?

也许今年税法把漏洞补上了，写着必须申请移民了才行。哈哈
