《中华人民共和国国籍法》
3 @; v( J* \& a/ Z  & E) S6 n2 f2 \4 f
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。" n- u( Y  c# u# r: @' |1 ]" X+ f5 ]
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
& ?2 j+ g* |# y  B$ ]. t! g3 Y# A9 @0 v3 r    第三条    中华人民共和国不承认中国公民具有双重国籍。! n+ K7 p0 |% o
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
6 u8 O* |# d; e1 E1 L) W% ~    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* ~+ ?; Y! Y% k# U0 v: P
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。& ]; i9 N, O5 m% ~
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
  |" g' x! i5 _    一、中国人的近亲属;1 Y2 A6 Z$ J/ ]+ s9 O: O7 y4 j
    二、定居在中国的;
7 p! C3 g. g  q9 x    三、有其它正当理由。; ^1 [; j; Y; O% J/ c$ ?  ~
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
5 @" v1 B. N( y& j' r; U: h    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。  q  C  T( P, r
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
: s+ _% c7 N& J/ ^5 }    一、外国人的近亲属;
! R2 l+ ^$ [' I5 t- ^7 N4 h    二、定居在外国的;* j  k7 _+ t- m7 w1 w/ G3 H* f' X/ p
    三、有其它正当理由。  \) |$ g& T0 E1 U  K/ K3 l
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
5 X  i6 p1 w7 Z& N1 _    第十二条   国家工作人员和现役军人,不得退出中国国籍。; s0 s9 K) x! l" q  S
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
6 p3 G- Q: s: I( z* O6 X    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 o; c# j) ]$ l" Y6 O2 y7 ?
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
* M. K2 }4 Z* J/ H9 q' y0 I    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
9 T. |& |' h9 Y( O    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。: ?( N& Q3 j- i9 B; d9 p! s
    第十八条   本法自公布之日起施行。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of/ S9 N6 v$ j, H$ {, V. _7 z9 ?
nationality of the People''s Republic of China." r& r* c. H2 w) n  Z/ Z
Article 2& a( M! ]" ~) ~+ o4 m( E2 K: q
The People''s Republic of China is a unitary multinational  state;  persons
0 d9 o7 v, u4 Q. _belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
% V) K+ a7 p) t8 G" g8 ?# b! wnationality.
# `# P( g. h0 k% o2 K1 vArticle 3
. Z5 f) N# _3 A% Y6 ZThe People''s Republic of China does not recognize dual nationality for any
) t2 u9 o! c8 o4 K, hChinese national.( ?9 W3 s% g+ z
Article 4
& g3 U$ y  f# LAny person born in China whose parents are both Chinese nationals  or  one4 R" M- `& `3 m7 K% N& K: }- F2 g
of whose parents is a Chinese national shall have Chinese nationality.' @5 d" g. t$ o# k) G) P( p
Article 56 i! m: L6 M# l$ k7 }* |
Any person born abroad whose parents are both Chinese nationals or one  of
7 x4 S" z; O( t" [4 b, ?. _3 Iwhose parents is a Chinese national shall have Chinese nationality. But  a
- e9 e4 L* P3 L; Fperson whose parents are both Chinese  nationals  and  have  both  settled
/ S! b4 I: x  V3 M* m# B+ ?5 Mabroad, or one of whose parents is a  Chinese  national  and  has  settled
& w, z1 Y9 C( \abroad, and who has acquired foreign nationality at birth shall  not  have% V1 H+ Y, {6 D! C+ A  {9 B& |
Chinese nationality.
+ E; z  D( C( k/ E9 u/ H+ iArticle 6; H% p' p* F9 G" P; _( P
Any person born in China whose  parents  are  stateless  or  of  uncertain3 q( w7 r. u' l0 X! e0 Z
nationality and have settled in China shall have Chinese nationality.
( V2 I0 D  i9 M) M8 Q! ^Article 7
. m" X  {$ Z8 q- AForeign nationals or stateless persons who are willing to abide by China''s3 s/ s3 K# x3 [) g& q4 n0 C2 ^& l
Constitution and laws and who meet one of the following conditions may  be
7 O8 z* `( `5 b5 pnaturalized upon approval of their applications:5 r0 V9 i) o8 e" w
(1) they are near relatives of Chinese nationals;0 F# \8 M! S- k" |, G" b6 x
(2) they have settled in China; or# H7 `7 o$ c* u0 R# \
(3) they have other legitimate reasons.$ _6 E+ D0 O8 `, O
Article 8
3 u- h7 H  k5 r" pAny person who applies for naturalization  as  a  Chinese  national  shall4 `2 |- m# J0 {( ~
acquire Chinese nationality upon approval of  his  application;  a  person+ V: p# G3 o9 L* q; ?( r( f
whose application for  naturalization  as  a  Chinese  national  has  been* Q0 T% T8 C, \( _! T& r
approved shall not retain foreign nationality.
) i% S2 I. ?" [  VArticle 9
3 w8 S& o, P' e6 K, NAny Chinese national who has settled abroad and who has  been  naturalized
# r6 n+ ~9 D- tas a foreign national or has acquired foreign nationality of his own  free
( l1 ~  W0 Z0 U  kwill shall automatically lose Chinese nationality.
9 U! ]' H; f) b' j  cArticle 105 Y, [5 a* ^$ D$ d
Chinese nationals who meet one of the following  conditions  may  renounce
8 E5 b- a" n8 ~4 t9 AChinese nationality upon approval of their applications:8 p% w; o1 l+ t4 ^# k
(1) they are near relatives of foreign nationals;
' P+ Z' n7 a2 r(2) they have settled abroad; or
' O$ I, c. G: {4 j$ ^4 `5 U# Z; H(3) they have other legitimate reasons.+ {+ D( l6 _. Q. G6 K2 w
Article 11! `: v# q* B/ |, c; }1 }
Any person who applies for renunciation of Chinese nationality shall  lose; q2 d" A7 w# `- L- L8 K( L/ _7 e
Chinese nationality upon approval of his application.! d7 A/ u8 I6 d$ r
Article 128 e* @+ p! [( v# i* r
State functionaries and military personnel on  active  service  shall  not2 C% A8 Z( F- e3 p( C
renounce Chinese nationality.. Q( D' V5 Z2 G0 x
Article 13
. v4 S% S3 J( N! nForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
0 P' c* ?& a) j- e0 irestoration of Chinese nationality if they have legitimate reasons;  those
" e0 ?: L% J8 x: s" z8 \whose applications  for  restoration  of  Chinese  nationality  have  been
, w2 Q/ [" f9 Yapproved shall not retain foreign nationality.
0 w$ k" F& g9 r" A. y6 g+ c. JArticle 144 b: v' ]# e/ z2 G
Persons who wish to acquire, renounce or restore Chinese nationality, with
2 j2 h( ?( ], [! S) n5 w. pthe exception of the cases provided for in Article 9, shall go through the
; K% Z* [9 _6 p/ `formalities of application.  Applications of persons under the age  of  18
7 _, h( i% h7 R& hmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
, c. U7 M/ c/ ]% V$ D" orepresentatives.
0 U* l+ k% W8 p$ OArticle 15/ S8 b5 ^$ q& S( i9 f, j
Nationality applications at home shall be handled by the  public  security+ A' a. c9 f5 z9 B
bureaus of the municipalities or counties where the applicants reside;
: T4 U4 A( f5 B! y1 qnationality applications abroad shall be  handled  by  China''s  diplomatic) K6 D* w4 M) L% f
representative agencies and consular offices.3 f6 R6 U( s3 y8 X) ~+ E$ n8 S
Article 16. T5 N) H- R* X9 j* o- M
Applications for naturalization as Chinese nationals and for  renunciation+ h4 g1 ^7 K8 }' L3 w# M+ d" G
or restoration of Chinese  nationality  are  subject  to  examination  and
. l0 S% {1 l% c2 ]% S- Z1 M) t" e% gapproval by the Ministry of Public Security of the  People''s  Republic  of2 u7 s  z0 s9 H4 q" V3 I1 W
China. The Ministry of Public Security shall issue a  certificate  to  any& @; h3 @7 L: E7 O
person whose application has been approved.
) K5 U. a* i4 ?' v- LArticle 17
' @4 t+ p1 k( bThe nationality status of  persons  who  have  acquired  or  lost  Chinese* |+ \5 @5 T3 O/ `3 T- H
nationality before the promulgation of this Law shall remain valid.
$ j7 J- }+ u4 g3 B& GArticle 18% `5 q$ ^: y3 ^; U5 t9 z
This Law shall come into force on the day of its promulgation.
