《中华人民共和国国籍法》 ( i8 b( o! w; K$ w* @+ ^! g
  + q: Z8 R# N. Z0 Q4 T" c) |: q- l
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。8 {3 p- R: c- {! }( ]
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
0 T; O+ F2 j2 ^* b$ e3 Y5 x    第三条    中华人民共和国不承认中国公民具有双重国籍。, l, M8 x9 K  G
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。" U1 |: \# I0 @" q" y
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。  L  E2 \7 i# G9 K& U
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。, n% y9 o* J3 N8 v; L4 Q
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
6 p+ n! u& Z  j1 x* _2 ]  f    一、中国人的近亲属;, n4 Y8 P6 A0 N: C& G9 g, ?
    二、定居在中国的;
: t' Y( Q) Y3 h, `1 r  Z    三、有其它正当理由。
( X8 S* d7 b, u# U6 S! G    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
0 O& P( o5 _/ A    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。) [! u$ c( F: i7 ?5 K. m; b
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
/ C3 P( h& A3 a% r6 Q! K: w% Y    一、外国人的近亲属;/ {3 k: k* u! Q, |9 l1 c
    二、定居在外国的;
4 F; r; p5 Y% v  ~    三、有其它正当理由。
3 `3 l# F, @, {8 Z5 p1 x    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
$ _+ p, n$ J/ o7 @8 L0 H    第十二条   国家工作人员和现役军人,不得退出中国国籍。
7 }- d. [* h, [; R    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。5 K1 j9 ^& g4 P: p9 w
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。# ^3 \' F, Z' Y9 T% G2 }+ O
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
+ U0 A: i/ Y6 B1 r/ I% U0 I    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。  j  C( o9 _) T  d* K. w
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。0 ^; h" J0 f' f+ @& N: H
    第十八条   本法自公布之日起施行。

8 }- w! {+ l) C$ k) r8 KThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
' G% P( ?" s; L2 inationality of the People''s Republic of China.
- q4 F: O+ a8 A/ c5 [# xArticle 23 b( }1 _; g) w5 A- v9 [
The People''s Republic of China is a unitary multinational  state;  persons- L9 C+ |9 P' o( x) y) x, k8 T. b7 W
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
* Y/ ^( h  \& \3 p/ `nationality.
7 m3 D) c! I* b% j. I, AArticle 3
6 z% P0 ?( k: V. F; P5 V' \8 rThe People''s Republic of China does not recognize dual nationality for any9 c: L" m) b$ p% S- A% F, h
Chinese national.
2 w3 {' o" q# n1 z2 `4 N/ QArticle 4
: x* b( x: H2 j7 e4 _5 _Any person born in China whose parents are both Chinese nationals  or  one# L' B) W/ z4 x  L; X+ ?
of whose parents is a Chinese national shall have Chinese nationality.
$ \" }4 K# E9 ]. a6 l  _  y( FArticle 52 Q3 A6 h$ f; a1 @
Any person born abroad whose parents are both Chinese nationals or one  of
, ?; k" V* F3 _; g- C+ |whose parents is a Chinese national shall have Chinese nationality. But  a2 W* \0 B9 ]& \6 i, d
person whose parents are both Chinese  nationals  and  have  both  settled
6 D) T5 a9 Q8 Z, {; a% m9 Cabroad, or one of whose parents is a  Chinese  national  and  has  settled$ Z' o  I: z1 {. i5 i
abroad, and who has acquired foreign nationality at birth shall  not  have6 K, g0 ^4 M* ?& Z
Chinese nationality.
+ T; v3 u0 A, \' @9 \& c% LArticle 67 g, b# J& K  K* A+ p% n
Any person born in China whose  parents  are  stateless  or  of  uncertain
& q4 H  h9 M7 U  `/ }; rnationality and have settled in China shall have Chinese nationality.- p" t- ~8 w+ u) c
Article 7
2 K+ j. ^: G9 NForeign nationals or stateless persons who are willing to abide by China''s
6 ?5 m: T8 j& `, }Constitution and laws and who meet one of the following conditions may  be* B! ^8 B' g9 A6 x; ^
naturalized upon approval of their applications:0 S4 v7 r+ n8 T) u
(1) they are near relatives of Chinese nationals;
9 P# U1 }. L' @1 B5 ](2) they have settled in China; or7 @( h0 L! g) C& ^7 I) j
(3) they have other legitimate reasons.
  }% Q1 v$ l1 J6 l2 EArticle 8. j7 ]% F# _+ c0 a/ {9 F
Any person who applies for naturalization  as  a  Chinese  national  shall  b& W$ e( G/ A; _( R- @
acquire Chinese nationality upon approval of  his  application;  a  person! U" g5 H3 P2 P& a/ A6 ~
whose application for  naturalization  as  a  Chinese  national  has  been
, \. q, m1 {; n( `, C9 [approved shall not retain foreign nationality.; t' M& K( F. C9 v1 G( q
Article 9
, ~+ Q2 \& K5 {" q- i4 GAny Chinese national who has settled abroad and who has  been  naturalized+ `7 y7 x% S1 }1 k: U3 b) a
as a foreign national or has acquired foreign nationality of his own  free+ j) g! ]# \' J$ A( g
will shall automatically lose Chinese nationality.
( C! W& c+ s8 A. uArticle 10) m+ j6 W7 I# J. a6 ^+ N" C
Chinese nationals who meet one of the following  conditions  may  renounce; [% [4 b$ Q! ]+ J6 m
Chinese nationality upon approval of their applications:% D; v5 x9 y4 L8 ^4 m8 f
(1) they are near relatives of foreign nationals;
% N; ~: f- @0 X' G% p2 N0 y& X- i( X, P(2) they have settled abroad; or, Y/ w" T9 W+ G/ V2 v; P0 T
(3) they have other legitimate reasons.
; h+ d" a( X# q! V- z7 c" p0 m& c& ~Article 11. x$ Z! H* H1 M+ o! u
Any person who applies for renunciation of Chinese nationality shall  lose0 [: w; U2 i1 k/ b0 K  }0 X
Chinese nationality upon approval of his application.: Q( b: U3 y2 n
Article 12
0 S( o5 K) q# ^State functionaries and military personnel on  active  service  shall  not4 O  }# o! U6 F
renounce Chinese nationality.
; C1 O3 v5 y4 F& V) I$ F) hArticle 13
0 P* S( ~+ m% r2 I2 uForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
& W  V2 o- a- I! L, prestoration of Chinese nationality if they have legitimate reasons;  those
8 p. L  ^! d6 Y7 rwhose applications  for  restoration  of  Chinese  nationality  have  been
  ^# k" S. \& b' {# k( [& F7 Zapproved shall not retain foreign nationality.! u- b/ z7 A' n8 S7 J* W- ]
Article 143 E( X* Q# @: |% `" ]% {, {( L
Persons who wish to acquire, renounce or restore Chinese nationality, with# Z- `$ A8 d* L; p! ]
the exception of the cases provided for in Article 9, shall go through the
; q, f1 P  P& @! B& u- ~" L6 {formalities of application.  Applications of persons under the age  of  18
# d( i/ A5 X1 ]/ M3 _7 o; C( y# D# @0 Kmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
5 _& K) A; m1 d/ ~- \2 Erepresentatives.
7 h9 X9 A0 O3 N% m: eArticle 15
# L0 o# c8 Z8 g1 INationality applications at home shall be handled by the  public  security
" c/ F/ G9 t0 B3 |bureaus of the municipalities or counties where the applicants reside;
5 a% i. ^( X! s* o  {nationality applications abroad shall be  handled  by  China''s  diplomatic
/ U" y; e; V; |9 }/ V9 jrepresentative agencies and consular offices.$ Z# X! x6 H+ p/ l) e
Article 16
' Q# l3 V- ?9 T8 aApplications for naturalization as Chinese nationals and for  renunciation3 H2 r& t/ _! W/ C4 j( r2 E
or restoration of Chinese  nationality  are  subject  to  examination  and3 y. x! \: V5 s. a0 A
approval by the Ministry of Public Security of the  People''s  Republic  of8 c; `9 g3 H5 {* t! Q$ x
China. The Ministry of Public Security shall issue a  certificate  to  any4 O* e4 B% k. X  N1 y0 n8 I; G
person whose application has been approved.
+ D9 V$ b. K: Z) RArticle 17
+ O2 `1 `' y: f1 K9 }6 n1 jThe nationality status of  persons  who  have  acquired  or  lost  Chinese
  }8 p+ n5 b9 G& }5 _. mnationality before the promulgation of this Law shall remain valid.9 O4 h, g! S3 ?% ^( C1 c2 z
Article 18
* u5 V/ f+ o; ~5 e7 t1 z+ D3 r. dThis Law shall come into force on the day of its promulgation.
