  : B8 C" h! z! ]! _& v
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
! Y- v  X7 ^; U    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
$ @8 r5 \0 p" M4 Y7 y( T+ \    第三条    中华人民共和国不承认中国公民具有双重国籍。: u1 T7 A  T+ z* y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。0 Y- Z3 v7 }: H9 m$ R
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
, o' I% y; ?5 S) a    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
% \. y) u+ u/ _& S) y0 ^( G    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
9 Y/ g: w9 t- s! O    一、中国人的近亲属;
& h0 D; m/ b* D0 E    二、定居在中国的;: ]$ j0 q$ H' |* v& z
    三、有其它正当理由。" `1 E1 B$ B; ~% ?  A
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。$ m# o. J) P/ Z' Y6 B
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
/ T! r4 i6 b: o    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:9 N: w- N( p" h3 Z0 V% W
    一、外国人的近亲属;
4 \9 {+ s/ v4 O  z, R  ]2 L* E    二、定居在外国的;  G# w# H4 W8 f: @3 E& N  s% r
    三、有其它正当理由。" h& V- z. T. \0 S
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。0 J& `) Z) X# N0 ~( Q$ m
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
8 b3 N! S* M1 B% `    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
- N0 G/ V, y3 S6 \    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。2 F, |; b# N% ^
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ r0 Z9 \  x$ L  G2 i    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( i: l) J2 J7 Y- w0 P/ x7 B    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。+ i' k  h% y/ c! {8 K, h: q: }
    第十八条   本法自公布之日起施行。

Article 1
/ c: l) A0 y! @, T$ o8 JThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
8 U  b& g; K9 ?. w. y2 _+ mnationality of the People''s Republic of China.
+ w, \9 x0 o/ I2 U; [; D5 g2 eArticle 2
" q, A/ i- _8 F' @6 z; y& EThe People''s Republic of China is a unitary multinational  state;  persons% c" M& z2 x0 ^
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
! I! G3 x$ ~2 u" K: d0 x2 jnationality.
3 q- u; A; ~- ~$ J4 L: S! LArticle 3
% }' ^# {4 q* v1 ~! C; B& [5 BThe People''s Republic of China does not recognize dual nationality for any5 I& `$ n8 Q/ b  \7 n
Chinese national., G9 l2 \4 {- @% l8 H$ _
Article 46 s/ [! W0 o7 n! r
Any person born in China whose parents are both Chinese nationals  or  one3 ^+ G9 A5 r) J8 x$ N! ~& P
of whose parents is a Chinese national shall have Chinese nationality.  [- m# [& s5 h7 s+ D
Article 5& y$ d. ~, S7 C7 k
Any person born abroad whose parents are both Chinese nationals or one  of2 H5 o5 }% G- `3 o& I
whose parents is a Chinese national shall have Chinese nationality. But  a. _4 {3 }. b! k- [- O9 K
person whose parents are both Chinese  nationals  and  have  both  settled1 ~% S5 e0 }5 M! C
abroad, or one of whose parents is a  Chinese  national  and  has  settled2 q8 J& H: F, S( o$ }, ]9 l
abroad, and who has acquired foreign nationality at birth shall  not  have7 l: B& q% z8 s! `! L2 E
Chinese nationality.
3 K8 G3 h. u. H( X# uArticle 67 l9 n6 s# r8 t# ?
Any person born in China whose  parents  are  stateless  or  of  uncertain
% m7 V1 a6 W- C, Dnationality and have settled in China shall have Chinese nationality.3 O3 e, o: Q) u8 T# i& b
Article 7# X, f$ H: Y  N, x* @9 a3 f4 Q
Foreign nationals or stateless persons who are willing to abide by China''s
4 T. ~, `# h: V5 q  _Constitution and laws and who meet one of the following conditions may  be
1 d' P: a) N$ D% }5 [( Cnaturalized upon approval of their applications:9 V, c. G+ Q% {. u6 S$ x
(1) they are near relatives of Chinese nationals;
9 ^. t5 t' j  e0 _+ T8 ?3 z' e3 i1 E(2) they have settled in China; or
( A, f7 i& T0 l* {+ b(3) they have other legitimate reasons., s3 O" e" n- w' b! g" ?
Article 8
4 `/ C7 O$ l' B, J5 G; IAny person who applies for naturalization  as  a  Chinese  national  shall* l) Z7 l: |# u  `
acquire Chinese nationality upon approval of  his  application;  a  person6 }& W3 ]" ^, j+ B) }7 Z
whose application for  naturalization  as  a  Chinese  national  has  been
: E! \3 |) z' A7 |' X, g4 Tapproved shall not retain foreign nationality.
6 c. ^. M8 `* _Article 9
4 ]8 R5 x4 k3 S$ o2 {8 yAny Chinese national who has settled abroad and who has  been  naturalized
0 Q7 e8 Q/ O7 h$ G. e$ u3 ?; @as a foreign national or has acquired foreign nationality of his own  free
" j4 }+ z; t6 Q9 `1 Awill shall automatically lose Chinese nationality.% Q! l6 C  N. s# h# \$ y
Article 10
1 @4 |, }+ D* ?+ f  p5 _Chinese nationals who meet one of the following  conditions  may  renounce
; U! |6 O, L+ P8 o. u0 uChinese nationality upon approval of their applications:( V4 _& A) ~' D
(1) they are near relatives of foreign nationals;6 g% }4 ], b3 c. J' l2 k. h) b
(2) they have settled abroad; or
$ Y& [8 u  J" M" s7 z9 F! V$ a(3) they have other legitimate reasons.% t7 h- o# S) [5 I
Article 11! }6 i0 {; a+ x- k& C7 f
Any person who applies for renunciation of Chinese nationality shall  lose
, `1 L% a( k. MChinese nationality upon approval of his application./ y- ]# {" v8 H* \
Article 12. C* o; w+ U4 u$ z
State functionaries and military personnel on  active  service  shall  not+ B4 d2 e# E9 d* _, D7 D5 u
renounce Chinese nationality.1 q/ I- B; p' H; P
Article 13
3 O, F; V4 O+ FForeign  nationals  who  once  held  Chinese  nationality  may  apply  for8 v! D! G! Q0 D
restoration of Chinese nationality if they have legitimate reasons;  those
/ J& d! W5 @/ @% w* Twhose applications  for  restoration  of  Chinese  nationality  have  been4 c/ G* P* w( W  p1 X! E
approved shall not retain foreign nationality.
/ }4 X7 [9 }% c0 a: gArticle 14
  ?# g3 O1 q8 a) G: }, g) w4 S; U% HPersons who wish to acquire, renounce or restore Chinese nationality, with! n) W* S: F. r: o/ v
the exception of the cases provided for in Article 9, shall go through the: N4 ?. K  o1 u5 _8 R" `
formalities of application.  Applications of persons under the age  of  18
9 `3 b; u7 T; d* ?' D7 @& Xmay  be  filed  on  their  behalf  by  their  parents   or   other   legal6 P' \; P! v9 }& S
representatives.
% `# \( [) a* _: }6 ?% gArticle 15. w: B9 T( O5 c5 S
Nationality applications at home shall be handled by the  public  security9 s6 X. O3 o' w- ^
bureaus of the municipalities or counties where the applicants reside;' s  J+ @5 ~. |! t
nationality applications abroad shall be  handled  by  China''s  diplomatic
0 f. k6 K3 c: q. h% Vrepresentative agencies and consular offices.# R( N5 w- P: w1 Q
Article 16
/ E1 {" D# h( q5 [5 f; {Applications for naturalization as Chinese nationals and for  renunciation* S  B0 V6 }# A8 ^4 T. ?$ _
or restoration of Chinese  nationality  are  subject  to  examination  and  |( G, Q4 h8 T0 A9 J
approval by the Ministry of Public Security of the  People''s  Republic  of
9 D' f7 M! h* M( N: w; p" PChina. The Ministry of Public Security shall issue a  certificate  to  any8 e* h: Y' j$ N6 Y9 D* L( l
person whose application has been approved.7 S9 @) O0 M. K: m
Article 17
. F; R& t  [6 v6 ~* PThe nationality status of  persons  who  have  acquired  or  lost  Chinese# {7 u0 |0 Y2 n# l4 E" i! F
nationality before the promulgation of this Law shall remain valid.3 K' Y3 u) l  }
Article 18. X1 S; E+ M7 E, {% E7 f
This Law shall come into force on the day of its promulgation.
