第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
1 R" k9 ?. y9 H# k# r U R+ s 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
& C# K7 c5 A! k8 R/ ], t 第三条 中华人民共和国不承认中国公民具有双重国籍。
4 U; d* d$ v$ j 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。- }! r" x8 t S% p5 h
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。4 U% L+ v4 _! a. R: F C. [
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
9 ?$ Z. B- l. R! K 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:+ l- N* T8 ^$ O) @ O/ p; x
一、中国人的近亲属;
, c! Q/ x+ H, E9 l/ J2 N! B 二、定居在中国的;: }: a' j4 n% F
三、有其它正当理由。
; I& |! n4 P+ v7 M( w; }/ y 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。: o' T2 p" }- f% J7 B0 H
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
3 ~; r2 ]9 \, D6 k, L0 [ 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
7 |! `" P, N. _' k' ] 一、外国人的近亲属;6 f9 Y) H# M* p# y& S. e% L
二、定居在外国的;
7 F9 s" Q0 P9 v P3 m 三、有其它正当理由。
9 k7 p' R4 L$ p, Q* ^ 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。: [' r( A! O% V7 K q6 v
第十二条 国家工作人员和现役军人,不得退出中国国籍。
& C$ R" e* K# J4 y- G 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。) D! n: O1 D9 H$ G4 K3 y6 \
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。; Y. `( E. E$ K5 Z0 F) A
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ c3 P. B3 Y5 ?% {$ D 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
; f2 [8 S( {$ a1 l) { 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1

Article 2

Article 4
" Y' H+ W- |7 i& I* q* m4 ~Any person born in China whose parents are both Chinese nationals or one1 |- T8 ?3 z D0 e3 R3 s, t( c6 J
of whose parents is a Chinese national shall have Chinese nationality.) {3 \* K+ n' |' T5 R
Article 5 I+ q" {* v. E2 z, R
Any person born abroad whose parents are both Chinese nationals or one of
- F. ^2 z( E5 [. M# W) cwhose parents is a Chinese national shall have Chinese nationality. But a( e& a' Z% k; b6 q
person whose parents are both Chinese nationals and have both settled$ ]+ h2 L+ K' z( _! `
abroad, or one of whose parents is a Chinese national and has settled
2 [ L/ k9 Z1 pabroad, and who has acquired foreign nationality at birth shall not have
& W3 G: v* u6 a, @" j$ H1 G, M+ |Chinese nationality.

Any person born in China whose parents are stateless or of uncertain5 L9 r3 X( H, t" d9 w$ w- I) b( U7 a
nationality and have settled in China shall have Chinese nationality.6 h7 [% h" i0 D, d

Foreign nationals or stateless persons who are willing to abide by China''s
- [, \: p9 V0 W2 ~5 @Constitution and laws and who meet one of the following conditions may be
4 t, v% A3 j3 a0 O4 i8 Qnaturalized upon approval of their applications:1 u4 e1 D4 m" T) F
(1) they are near relatives of Chinese nationals;7 P% L2 Y8 ~9 G5 F6 l6 m. R' F( _0 }
(2) they have settled in China; or
/ L1 e' J* r& t(3) they have other legitimate reasons.8 W' m- h7 Z4 N" \- O8 w
Article 8/ r1 |8 `+ C, F3 B! l
Any person who applies for naturalization as a Chinese national shall
* }8 Z- _# w5 O7 H3 wacquire Chinese nationality upon approval of his application; a person
( W, S: {" w/ J, J6 pwhose application for naturalization as a Chinese national has been2 y4 }9 f3 T% Y$ `* B: F- e
approved shall not retain foreign nationality.% D- `' A7 S5 w' O
Article 9# l7 @3 L; p0 w: V2 {. S
Any Chinese national who has settled abroad and who has been naturalized
]4 ^( y$ ^: h: h! Eas a foreign national or has acquired foreign nationality of his own free3 P: \8 O A* s4 V3 @/ ]
will shall automatically lose Chinese nationality.
! A) G6 m3 J0 EArticle 108 ]2 m0 @6 a! X# d8 P
Chinese nationals who meet one of the following conditions may renounce7 x) [" N5 z1 @" j
Chinese nationality upon approval of their applications:
6 W' V# O. V' }0 P, V; K(1) they are near relatives of foreign nationals;
. Z: A! ~. E& t* L0 d(2) they have settled abroad; or, ~% l- y( E6 |* L1 f0 x9 H _6 A* z
(3) they have other legitimate reasons.

& Y# B6 f5 s) w }3 PAny person who applies for renunciation of Chinese nationality shall lose; @ G: W" P7 P; A
Chinese nationality upon approval of his application.! M4 t" v- |/ E
Article 12
( u, q" s9 n! u$ p7 C aState functionaries and military personnel on active service shall not$ @0 \' g4 U$ J/ a' |
renounce Chinese nationality.5 z& c. k: V. ^" K$ x, a3 t1 \3 k" m
Article 13
0 E. j# } v. L+ q$ w# V6 KForeign nationals who once held Chinese nationality may apply for4 l# z. O- I3 [/ h9 v1 Z
restoration of Chinese nationality if they have legitimate reasons; those
, h& J; I4 i6 L& }; P2 V1 Ywhose applications for restoration of Chinese nationality have been
0 }/ p3 U, `$ I1 B3 Y4 aapproved shall not retain foreign nationality.# c4 Y7 _$ d( v2 x' I, u5 k
Article 14, o% p8 j" z$ j, X
Persons who wish to acquire, renounce or restore Chinese nationality, with2 S( W$ {; |4 t, X# Z
the exception of the cases provided for in Article 9, shall go through the
) z& S# [( h3 h8 E7 Aformalities of application. Applications of persons under the age of 18' ^: l( i3 f$ @' L% X
may be filed on their behalf by their parents or other legal8 k2 x; T' x$ n2 e
representatives.

6 j/ j7 H1 F) W) C, c( D& KNationality applications at home shall be handled by the public security
# J' \; x# n5 R5 d H$ {" ybureaus of the municipalities or counties where the applicants reside;
* c$ o* A+ W, F5 E5 xnationality applications abroad shall be handled by China''s diplomatic
0 C2 ?; k6 L/ yrepresentative agencies and consular offices.+ A, `" c* ^( \- N1 p
Article 16. x2 R( U5 x( K6 s5 v/ S( l
Applications for naturalization as Chinese nationals and for renunciation
4 y k% R8 I; ^1 ^or restoration of Chinese nationality are subject to examination and
+ Q" i' e* Y- c) H( G/ happroval by the Ministry of Public Security of the People''s Republic of8 m% d. ?6 W4 p. ?5 U
China. The Ministry of Public Security shall issue a certificate to any5 J. U3 y% s' ?" O: r
person whose application has been approved.9 n1 l1 }, F! s3 w$ P
Article 17
8 O. s W. \2 n' H6 S0 `3 PThe nationality status of persons who have acquired or lost Chinese" U% t: h4 ~, w j1 i: Q
nationality before the promulgation of this Law shall remain valid.

: H8 i5 u' s: l+ J3 I* K) ^This Law shall come into force on the day of its promulgation. |
