第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
; u9 D' y _; v: O; x, w; x 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。( L3 k+ x0 x# m6 g- L# @
第三条 中华人民共和国不承认中国公民具有双重国籍。

第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。3 T1 B. n& Z0 ^
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。1 c* y& B$ q2 P5 |5 G) ^# ?
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:/ `& k- F$ M& k
一、中国人的近亲属;
0 u7 J% k1 d2 S7 j 二、定居在中国的;2 R' n) r5 V6 H+ F. r0 k1 S3 d
三、有其它正当理由。
% k: R8 ^5 \2 Z2 i2 w9 Y/ z; O 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。

第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。5 b1 H* S7 u" r5 m
第十二条 国家工作人员和现役军人,不得退出中国国籍。/ Z- z( Y7 ?9 D
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。: B8 j% Y. n8 d. X1 {2 r
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。3 K! G6 I9 F; q5 l4 V* ~
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 l9 d" |6 [6 `( n0 m/ Z; L W( k 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( j: Y) ]4 W3 T 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China is a unitary multinational state; persons: D8 ?" o: L/ `
belonging to any of the nationalities in China shall have Chinese

Any person born in China whose parents are both Chinese nationals or one

( c5 s" T$ M: F1 b/ nAny person born abroad whose parents are both Chinese nationals or one of
4 g' R& [# a. w+ D9 u% F) ^whose parents is a Chinese national shall have Chinese nationality. But a' Q2 V/ Z, h/ F. s2 u
person whose parents are both Chinese nationals and have both settled: H0 X, M. A+ E2 S
abroad, or one of whose parents is a Chinese national and has settled; y% |8 J {1 u) d5 L
abroad, and who has acquired foreign nationality at birth shall not have1 z. S" r6 ]( N& |. O2 H
Chinese nationality.

Any person born in China whose parents are stateless or of uncertain9 H, s; I+ k& @3 g0 u6 `

Article 7
/ P. d+ O' ?* Y+ B( Y( G4 h9 bForeign nationals or stateless persons who are willing to abide by China''s7 Z. I- M( }( g# f0 m7 D' I
Constitution and laws and who meet one of the following conditions may be5 b6 c! Y0 ^ C
naturalized upon approval of their applications:
- W6 B, }1 @! Z6 h9 K1 i(1) they are near relatives of Chinese nationals;- Y7 _9 {5 S& y" M; z, e$ }- _
(2) they have settled in China; or
1 x" M7 D) [, N# \6 h(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
6 v9 K/ x) j% i/ }. V$ K+ Z6 Gacquire Chinese nationality upon approval of his application; a person
3 G4 b, L) ?. A: ?whose application for naturalization as a Chinese national has been
( a; n/ b8 t0 u9 m3 c5 Y4 `6 xapproved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
) D# c w6 v: T8 \* }' l0 _) qas a foreign national or has acquired foreign nationality of his own free
2 x3 Z0 \ F, J* B- F2 Q$ ^) swill shall automatically lose Chinese nationality.( B9 m9 J# L9 A) u: `
Article 10
a% K, U- @! y8 ~! u0 L5 h+ A& PChinese nationals who meet one of the following conditions may renounce, t0 p; T+ x. G4 W4 V; t) S
Chinese nationality upon approval of their applications:5 |# ], J4 z2 T0 A# l
(1) they are near relatives of foreign nationals;
+ R( y& ~1 d- ?6 u(2) they have settled abroad; or/ k* C9 n1 T @' Z) f% h" |
(3) they have other legitimate reasons.' a3 y$ s* s3 T
Article 11, s/ P. ^" |# y+ ]% E
Any person who applies for renunciation of Chinese nationality shall lose
1 c9 `: s0 q3 V, N2 r8 `5 MChinese nationality upon approval of his application.6 b3 c4 R* q$ c2 ?: N+ I; u
Article 12 ^3 f# o, L& ~6 [
State functionaries and military personnel on active service shall not
# ?" P% \* l4 E5 ?. y% Irenounce Chinese nationality.
( c% X: g1 H: M" W% w* x: {" EArticle 130 y5 e! V9 Y: W" v
Foreign nationals who once held Chinese nationality may apply for- C) b2 y$ I% Q8 `7 y
restoration of Chinese nationality if they have legitimate reasons; those
& D2 U0 z2 J; f# F# P& I4 [3 iwhose applications for restoration of Chinese nationality have been
! Q) e/ Q2 J1 A/ e, Zapproved shall not retain foreign nationality.
! f# m; e$ j+ yArticle 14
3 d# |1 u% t* _+ `9 w+ f* ~Persons who wish to acquire, renounce or restore Chinese nationality, with9 s( ]& [# a1 J; F+ L
the exception of the cases provided for in Article 9, shall go through the6 @, L& i' r! H
formalities of application. Applications of persons under the age of 18. D Q! G% `4 t
may be filed on their behalf by their parents or other legal% {* k+ A; n6 e- w0 i+ z/ Y
representatives.2 s: }: P1 |2 w" A
Article 15' B" Y% b9 A+ [% v- d" {) I: N0 j: k
Nationality applications at home shall be handled by the public security
- H; D5 X4 a0 x1 d0 V, @" @1 a ?bureaus of the municipalities or counties where the applicants reside;" R' U9 c. u2 I6 `4 o1 V5 ?
nationality applications abroad shall be handled by China''s diplomatic
, E4 e( u' @* P8 X' vrepresentative agencies and consular offices.8 I5 N* D) A( U
Article 166 `+ _( ?1 G" z6 T9 K) P7 b2 W, ]1 A8 w; o
Applications for naturalization as Chinese nationals and for renunciation( F8 w: [+ d' d2 b& s {! g
or restoration of Chinese nationality are subject to examination and
4 |$ W7 p9 c* I* b$ Xapproval by the Ministry of Public Security of the People''s Republic of
! H6 G: t, h5 r2 _: N+ [China. The Ministry of Public Security shall issue a certificate to any% z; F/ t) s8 ^( }- y6 ?
person whose application has been approved.# K0 Z2 _) u% Y3 F: j5 g9 t
Article 17
. k) S5 \ E- `+ v+ m% y. {The nationality status of persons who have acquired or lost Chinese9 i3 O; O' T' F5 v% F1 b
nationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
