5 Z) b, I! A' q9 [* B. D 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" a; [& E2 A3 |4 R+ r% l    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
: ^. e! W* n; p( i4 g6 \1 b) s) Q+ Z    第三条    中华人民共和国不承认中国公民具有双重国籍。
& a' B0 t7 a1 }    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
; e$ r2 {. d* s    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
: l) q6 R4 `0 e) S    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。1 c% N- r) o1 J! j, W/ f& l: G
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
  z0 f$ k2 y) Z    一、中国人的近亲属;
& w/ |; Z4 {8 R5 Z/ _    二、定居在中国的;2 r0 \' a, S# M# A) {" d" F5 ~
    三、有其它正当理由。
) @8 r3 ~' A2 q7 a    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
! i, |1 P2 N/ ?, T/ l    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。" }9 v" J: F1 n: E: k
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
# e6 C. `# x5 B    一、外国人的近亲属;) _. Z% C4 z/ R, R- {7 ?
    二、定居在外国的;* ^' A6 a8 }: V$ g0 f
    三、有其它正当理由。
9 N, a) r' L8 y! T    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。* k6 S5 r# |7 Z2 ]$ r7 o
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
8 G$ z) K' e: J6 R" E    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。3 z5 [# A0 S! L3 z; V" i9 x
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
' T/ c( L+ \( w- A  C8 T    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ M& _/ l; V4 ]: h  N7 B; H$ t$ j    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。4 |& g% f2 |, g- G4 E/ W  I% d
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 15 t+ g$ O: P/ L4 y
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of' U! F9 v' L' e2 a0 A
nationality of the People''s Republic of China.* W# g8 V6 c' U
Article 2
( T/ H, z) V3 b6 D+ z& ~The People''s Republic of China is a unitary multinational  state;  persons$ Q$ ?/ `7 ], f& ?" W9 @
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese/ |* V  P& |+ Y! {( g& P
nationality.8 ~/ O& j: b# k, Y$ Q8 D
Article 3
8 i0 l" j0 v) @( yThe People''s Republic of China does not recognize dual nationality for any# V; P) \9 F5 ]1 D) i8 j
Chinese national.* ^2 q/ Q; \+ ~; {- A
Article 48 i* B0 B5 q+ r
Any person born in China whose parents are both Chinese nationals  or  one
. n7 M, }2 C! q$ }* ~of whose parents is a Chinese national shall have Chinese nationality.
$ o# V+ \+ y  e# D$ n7 ~* I1 E9 DArticle 5. G( U- t% q  @! u0 e% e8 _, p
Any person born abroad whose parents are both Chinese nationals or one  of
  k- c; X8 r1 j, \# r" [whose parents is a Chinese national shall have Chinese nationality. But  a% V# G. N  h% F( r+ E5 e+ {/ [2 i$ I3 `
person whose parents are both Chinese  nationals  and  have  both  settled
* c. A5 O* ~1 ~, Tabroad, or one of whose parents is a  Chinese  national  and  has  settled
9 f# k+ [, |5 d$ b: habroad, and who has acquired foreign nationality at birth shall  not  have8 \( B. p4 }4 \4 l# D; ^& \  }2 t
Chinese nationality.# H, ^& E; K- h/ G8 S) |7 k
Article 6
9 O+ l# ?+ m2 z3 b; _$ r  rAny person born in China whose  parents  are  stateless  or  of  uncertain
$ M$ a% c4 o% Q" J0 Unationality and have settled in China shall have Chinese nationality.
" s& [: |5 }/ L3 @9 o3 `Article 7
7 |' O8 ^5 u6 F3 W* v5 q: ?Foreign nationals or stateless persons who are willing to abide by China''s, g( Q3 R! T. i
Constitution and laws and who meet one of the following conditions may  be
, n- C! P3 P# L2 [+ T! a" A9 ?# ]naturalized upon approval of their applications:' G! S, D$ G8 p
(1) they are near relatives of Chinese nationals;8 _/ D4 m" M) z# ]+ m
(2) they have settled in China; or
+ O! P9 I5 S& c, [; H* a(3) they have other legitimate reasons.
$ L. `) @7 W* S5 u" X0 gArticle 88 B2 V9 j. q* A& n7 V
Any person who applies for naturalization  as  a  Chinese  national  shall
! m% ^, v6 N. H# c1 y0 C3 v/ ]) ~acquire Chinese nationality upon approval of  his  application;  a  person3 X+ ]# Z# C  r( h; O0 h
whose application for  naturalization  as  a  Chinese  national  has  been
; l7 y# ~) I: L/ h6 E  g  O& japproved shall not retain foreign nationality.
3 y) O9 T- M. o8 |  bArticle 9$ K+ b% o: c5 l' D5 D
Any Chinese national who has settled abroad and who has  been  naturalized
3 q. b1 g1 ?% H1 L% Y8 las a foreign national or has acquired foreign nationality of his own  free
6 S: f7 s+ W) P3 F  u. m" u# e7 ywill shall automatically lose Chinese nationality.
. K! N& y2 S( o6 rArticle 10
0 J* f* x) h2 e; z1 i& _7 h0 e" \8 tChinese nationals who meet one of the following  conditions  may  renounce. Q1 I$ g2 Z* n' x
Chinese nationality upon approval of their applications:5 V( f, E5 {' y8 x& k, V
(1) they are near relatives of foreign nationals;
1 R2 |' Q* a( Q' N  Q6 e(2) they have settled abroad; or
9 T  g( e1 t! r% ?4 T( P( T(3) they have other legitimate reasons.4 i4 k: }- }0 s; d4 V9 i, U+ @
Article 11
: r5 u! v1 \% J& O, {2 gAny person who applies for renunciation of Chinese nationality shall  lose
- V+ Y' O' U4 X5 G% oChinese nationality upon approval of his application.
$ e5 C5 i% t! M2 V) TArticle 12  y- C8 i* i* e+ Q
State functionaries and military personnel on  active  service  shall  not) z6 g& M+ Q; r0 A# p9 O
renounce Chinese nationality.7 j$ \4 I% R. k
Article 13
7 p+ e* c* K& GForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
- g! [) I9 l+ [restoration of Chinese nationality if they have legitimate reasons;  those
, H% w, e  w: w9 ]0 E) fwhose applications  for  restoration  of  Chinese  nationality  have  been. x/ U7 B  x0 m4 Y6 `7 b, A5 J& g
approved shall not retain foreign nationality.# Y, G/ ^! E) H; ~1 N0 k1 M1 q
Article 14) `5 p! F( i. T3 W( C# |/ T
Persons who wish to acquire, renounce or restore Chinese nationality, with! W- ]  V3 W0 k
the exception of the cases provided for in Article 9, shall go through the
! b2 _$ ]% C1 b9 j) Uformalities of application.  Applications of persons under the age  of  18
, }- q, g- b8 L5 B1 Zmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
4 }7 H2 m4 t& F5 A. }2 E/ prepresentatives.
: _! s2 D* A& s' a- tArticle 15
0 v  v0 `7 s0 M  L5 n" RNationality applications at home shall be handled by the  public  security
3 m" P/ J* h! V, M9 {bureaus of the municipalities or counties where the applicants reside;$ p8 Y+ N: g: N0 w8 W8 s4 b
nationality applications abroad shall be  handled  by  China''s  diplomatic: k# }; F0 ]8 Q/ D% v& _1 K1 P+ W
representative agencies and consular offices.' z8 `% w% ?' D' \6 V) g
Article 16' `6 Y5 @1 z  P7 F& ?& y. F1 m
Applications for naturalization as Chinese nationals and for  renunciation
8 e: S" n% g! L7 Bor restoration of Chinese  nationality  are  subject  to  examination  and
  m) ~: G% _: k0 r7 R# U7 s3 L) uapproval by the Ministry of Public Security of the  People''s  Republic  of
* u+ }- X' K# }0 L. KChina. The Ministry of Public Security shall issue a  certificate  to  any
8 k: Z. R! q' A+ [0 H) Rperson whose application has been approved.5 P$ ?# t) ]$ @! B% f( M
Article 17. Q- i4 [7 c' x8 O+ C. L: W0 @
The nationality status of  persons  who  have  acquired  or  lost  Chinese
7 Z* p+ _) Z% h7 e8 m. h8 inationality before the promulgation of this Law shall remain valid.) a  @2 t( P! N  m
Article 18
7 _, }; n9 M: w! S% t, b* cThis Law shall come into force on the day of its promulgation.
