第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
% D5 n& I6 @' I    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
/ |) L; O- V  o- d1 H    第三条    中华人民共和国不承认中国公民具有双重国籍。* r2 t8 S$ N; k( r* L
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。! I- I2 c# a; g0 o1 k7 ~3 l+ R
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。" w  q, E/ n  w- {, f; H
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
$ z& r. t3 z2 o- f9 O    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
2 P% T  P# a/ p  g! w( s    一、中国人的近亲属;
: _# v- y& t3 M2 G5 m    二、定居在中国的;/ E9 E2 L  K: q7 u
    三、有其它正当理由。2 q  t8 V4 s1 x
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。; d8 f) ?0 u5 K: ^0 V3 j
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。, @  \6 B2 N& E1 X( j
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:$ s* }7 y# W3 n3 n" J0 p
    一、外国人的近亲属;# L4 V% U! h* b; T) z" n7 a2 w
    二、定居在外国的;
- D/ Q5 m0 O7 a: S2 q    三、有其它正当理由。1 K" v0 F) S- @& w( F# z  V! Z
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
9 q$ k/ A$ j4 ]- s    第十二条   国家工作人员和现役军人,不得退出中国国籍。- g5 S' E. {! e1 }% |2 p; U+ a, R- W
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。3 p  H3 l5 r& m. e" @8 f
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 C, S* D9 t  v9 P# g
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
8 _7 k9 _( h" p. k    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
! X/ r- ?# W- Q# T    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 18 I6 W& Y- @3 T( j- a# I
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of) G9 Y6 H5 ~$ C: ~& S
nationality of the People''s Republic of China.0 J! i: \/ f5 ]% N1 L$ a5 ?
Article 25 g. s. S% u& E1 R! C( I
The People''s Republic of China is a unitary multinational  state;  persons
* S: \1 w1 ]# y' e+ J4 V8 Q% Vbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
# @. j. S7 m; _5 w* ynationality.2 k) b2 g; h* k
Article 3
" y/ b  @, J" Z0 E% x# h5 BThe People''s Republic of China does not recognize dual nationality for any# t) ]+ A. L: z/ L% `
Chinese national.

Any person born in China whose parents are both Chinese nationals  or  one
- V- a8 m. l  {$ x* H" ~9 Pof whose parents is a Chinese national shall have Chinese nationality., Z1 B( r' C4 W! C
Article 5; U; s6 Y! C7 C! m6 z
Any person born abroad whose parents are both Chinese nationals or one  of
* B4 J% s1 A- J2 ?" ]( O* P, fwhose parents is a Chinese national shall have Chinese nationality. But  a, A: a: d5 T; C: i1 [) y# n
person whose parents are both Chinese  nationals  and  have  both  settled
- E' y& M: G6 G/ e% t) Q+ Aabroad, or one of whose parents is a  Chinese  national  and  has  settled1 G& N' U5 f+ n7 l" ]+ [
abroad, and who has acquired foreign nationality at birth shall  not  have8 u4 W; g( o, g  ^, @
Chinese nationality.

* i. V. b) Y: D& V' \6 hAny person born in China whose  parents  are  stateless  or  of  uncertain- p9 ^. \4 d1 _& q
nationality and have settled in China shall have Chinese nationality.

! |) ^& o# g# G1 D0 F% ZForeign nationals or stateless persons who are willing to abide by China''s/ _. J0 K0 }4 B' I2 ?. C
Constitution and laws and who meet one of the following conditions may  be. i8 A; ]' J" g5 b
naturalized upon approval of their applications:$ B7 J& k1 R' u* d' C& C% U
(1) they are near relatives of Chinese nationals;( J+ }2 i9 ]6 e; ?) [
(2) they have settled in China; or" O5 D3 z0 f* ~1 s" e/ R; d
(3) they have other legitimate reasons.2 y  b) l6 |7 W
Article 87 \- |5 U" [, [; J/ M2 F
Any person who applies for naturalization  as  a  Chinese  national  shall
3 d, W& z, h' q; p0 H0 u) _acquire Chinese nationality upon approval of  his  application;  a  person8 j! ~7 u8 o1 e7 v
whose application for  naturalization  as  a  Chinese  national  has  been
, |/ u7 }. C/ A* Y5 \2 Rapproved shall not retain foreign nationality.
. O6 N6 J! w- @- Q4 wArticle 9
1 x. M! L  m- XAny Chinese national who has settled abroad and who has  been  naturalized7 Y: M6 k- I  p/ q* [
as a foreign national or has acquired foreign nationality of his own  free  X( J+ y5 ?) \
will shall automatically lose Chinese nationality.7 P: ?8 \; h/ o2 @& y
Article 10
1 h. h2 r; t3 [  E1 y2 uChinese nationals who meet one of the following  conditions  may  renounce
4 \/ f6 J  }. I& MChinese nationality upon approval of their applications:- L9 G3 [2 e7 g5 G4 t
(1) they are near relatives of foreign nationals;
- a$ }: m- _# U3 x; a' ~(2) they have settled abroad; or. {* w2 o; _; E8 T5 @+ q, k8 E
(3) they have other legitimate reasons.
/ c- Z! b$ ?' c" VArticle 114 U( U1 M0 }7 s
Any person who applies for renunciation of Chinese nationality shall  lose. R9 H) W6 _! r, A& [
Chinese nationality upon approval of his application./ d9 u( t! R% b. w
Article 12
0 M8 T# k, {% l4 \* w; H6 M- iState functionaries and military personnel on  active  service  shall  not
2 ?; {7 J( }0 ^: i' rrenounce Chinese nationality.
/ q( x2 S4 A0 W2 @; b9 pArticle 134 n* D$ s- U. ~" Q) c" E
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
' {9 D- v2 |# V7 q  R- L2 Frestoration of Chinese nationality if they have legitimate reasons;  those
' q4 G' b& m/ b, S" \whose applications  for  restoration  of  Chinese  nationality  have  been! v$ j* o! B+ Q0 ?. ]
approved shall not retain foreign nationality.
& I' n- c1 b9 H% {- t4 e1 h  ?Article 14
* A/ B& Y% T9 S) ]! A$ Q6 t. l$ ^4 u% ?Persons who wish to acquire, renounce or restore Chinese nationality, with3 q( f' |9 m+ N$ V7 E
the exception of the cases provided for in Article 9, shall go through the
" V2 P9 [0 j  A1 d* D; Eformalities of application.  Applications of persons under the age  of  18
3 p$ Z0 @' w7 p4 K, N7 c5 F! F- Q4 gmay  be  filed  on  their  behalf  by  their  parents   or   other   legal- p" L' _  |$ X5 q
representatives.
/ r7 a8 X3 A. V: cArticle 15
) p( [/ m# w4 ]; p! g1 x% }Nationality applications at home shall be handled by the  public  security
1 V+ t" [$ H. s# ?9 Obureaus of the municipalities or counties where the applicants reside;
) c' @7 l) r, c) Y% J, s8 I- i$ y+ `5 Vnationality applications abroad shall be  handled  by  China''s  diplomatic; N' p  y  v( B# i- r+ B) P, S
representative agencies and consular offices.
: O! N# A$ T8 c( XArticle 16+ m9 u8 R6 [8 j: k& w
Applications for naturalization as Chinese nationals and for  renunciation
  I5 v" k. T# w# i, j" ?or restoration of Chinese  nationality  are  subject  to  examination  and4 f) b9 M- v9 I' B
approval by the Ministry of Public Security of the  People''s  Republic  of  n8 J& K* |0 q: n3 A
China. The Ministry of Public Security shall issue a  certificate  to  any
/ e2 T. N( s0 ]( E( `/ I6 k+ a) n) }person whose application has been approved.
2 ^4 n) T) o4 l/ S; o7 f4 aArticle 17
' T+ I8 m! e% p1 H8 ~; uThe nationality status of  persons  who  have  acquired  or  lost  Chinese
: }) i- {$ D" s4 P0 z/ n# Anationality before the promulgation of this Law shall remain valid.
/ s" ?" V- v4 V/ XArticle 18
: A/ d% a& t2 a8 u* D8 k# LThis Law shall come into force on the day of its promulgation.
